RECOMMENDATION:
It is recommended that the Zoning Administrator accept request to withdraw the application. There will be no hearing and the file will be closed.
SUMMARY/DISCUSSION:
RMA-Planning received an application for a Design Approval to clear Code Enforcement case (16CE00465). The subject of the code case was the non-conforming painting (orange) of a previously approved fence. The property is located at Carmel Riviera Drive, Carmel (Assessor's Parcel Number 243-153-002-000-000), Carmel Land Use Plan, Coastal Zone.
A Design Approval application was processed as an Administrative Design Approval (PLN170080). Staff mailed a “Pending Approval Notice” with an appeal date of April 7, 2017. On April 6, 2017, a concerned member of the public filed a request to refer the decision to the Zoning Administrator.
On June 13, 2017, a notice was mailed and posted for the June 29, 2017 Zoning Administrator hearing. On June 15, 2017, the applicant, Mr. Shirvani, notified planning staff that they agreed to revise the paint colors (See Attachment 1), to be consistent with the Carmel Area Land Use Plan, Policy 2.2.3.6, and the neighborhood character. This action clears the open Code Enforcement Case and negates the need for a Design Approval.
