a.  Approve of the response to the 2016 - 2017 Monterey County Civil Grand Jury Final Report: “A Top to Bottom Review of Monterey County Elections Department”; and

b.  Direct the County Administrative Officer to file the approved response with the Presiding Judge of the Superior Court, County of Monterey, by September 4, 2017.

RECOMMENDATION:

It is recommended that the Board of Supervisors:

a)                     Consider approval of the response to the 2016 - 2017 Monterey County Civil Grand Jury Final Report: “A Top to Bottom Review of Monterey County Elections Department”; and

b)                     Direct the County Administrative Officer to file the approved response with the Presiding Judge of the Superior Court, County of Monterey, by September 4, 2017.

 

SUMMARY:

The 2016 - 2017 Monterey County Civil Grand Jury Final Report: “A Top to Bottom Review of Monterey County Elections Department” was issued on June 7, 2017.  By law, the Board of Supervisors and elected County officials are required to respond to specific findings and recommendations as directed therein.  Within 90 days of report issuance, on or before September 4, 2017, the Board’s response must be filed with the Presiding Judge of the Superior Court, County of Monterey.

 

The County Administrative Office coordinated preparation of the recommended response to the 2016 - 2017 Monterey County Civil Grand Jury Final Report: “A Top to Bottom Review of Monterey County Elections Department” on behalf of the Board of Supervisors.  The Board of Supervisors approved response should be deemed by the Monterey County Civil Grand Jury and the Presiding Judge of the Superior Court, County of Monterey, as the response of the Board of Supervisors to those issues raised by the Grand Jury regarding County operations, except as applicable to elected County officials. 

 

The recommended response is intended to reflect staffs’ understanding of Board policy.  If the Board desires corrections or changes, we request you direct the CAO to submit the modified report to the Presiding Judge and Grand Jury, with copies to your Board. 

 

OTHER AGENCY INVOLVEMENT:

 

The County Administrative Office coordinated preparation of the recommended response to the 2016 - 2017 Monterey County Civil Grand Jury Final Report: “A Top to Bottom Review of Monterey County Elections Department” with the assistance, input and appropriate review by the following County departments:  Assessor-County County-Clerk and County Counsel.     

 

Members of the 2017 Monterey County Civil Grand Jury and the 2017 Presiding Judge were invited to attend the Board of Supervisors hearing on this matter.

 

FINANCING:

 

There are no fiscal impacts to the General Fund with this recommendation.
