RECOMMENDATION:
It is recommended that the Board of Supervisors consider adoption of a position on Assembly Bill (AB) 1250 (Jones-Sawyer), a bill which would establish various standards for the use of personal services contracts by counties; and convey any position adopted to Governor Brown.

SUMMARY & DISCUSSION:
On September 12, 2017, Supervisor Adams submitted Board Referral No. 2017.17 requesting that the Board of Supervisors consider adoption of a position related AB 1250 at the September 19, 2017 Board meeting.

A report on AB 1250 was provided to the Board's Legislative Committee on June 12, 2017. At that time, the Committee was unable to reach consensus on a position on AB 1250 so took a "watch" position on the bill.

The County's State legislative advocates, Jennifer Capitolo and Ashley Walker at Nossaman LLP, have prepared the attached memorandum which contains the most current information on AB 1250.

As of this writing, AB 1250 is still making its way through the State legislative process. The 2017 State legislative session will conclude on September 15, 2017. If AB 1250 passes through the Legislature by that date, it will be sent to the Governor for consideration. The Governor has until October 15, 2017 to sign or veto bills, or if he takes no action the bills will automatically become law.

If the Board takes a position for or against AB 1250 it will be conveyed to the Governor by requesting signage of the bill or a veto.
