RECOMMENDATION:

It is recommended that the Board of Supervisors acting as the Board of Directors of the East Garrison Community Services District (EGCSD) adopt a Resolution to:

a. Establish an Advisory Committee for the East Garrison Community Services District; and

b. Adopt the East Garrison Community Services District Advisory Committee By-Laws.

 

SUMMARY/DISCUSSION:

The State Legislature (Senate Bill 1092) approved the creation of the East Garrison Community Services District (EGCSD) and named the Monterey County Board of Supervisors as the initial EGCSD Board of Directors.  The State Legislature required that the Board of Supervisors call for an election to determine if the voters within the EGCSD wished to establish an independent board 10 years after formation or, earlier, if the Election Department certified the existence of 500 registered voters within the EGCSD.  On May 5, 2017, the Monterey County Board of Supervisors called for the election, which was held on August 29, 2017.  On September 19, 2017, the Board of Supervisors received the certified Statement of Votes and declared final results of the August 29, 2017 EGCSD All Mail Ballot Election.  For the first ballot question, “Shall the East Garrison Community Services District have a directly elected Board of Directors,” the vote was 13 yes and 288 no, 4.32% and 95.68 %, respectively.  Based on these results, no independent board will be created and the Monterey County Board of Supervisors will act as the Board of Directors for the EGCSD.

 

An EGCSD Community Meeting was held on June 29, 2017 to address questions and issues related to the August 29, 2015 election.  Residents of the EGCSD expressed interest in creating an Advisory Committee should the ballot measure establishing a directly elected Board of Directors fail.  After the election, Special Districts staff received a referral to create an advisory committee from Supervisor Parker’s office.

 

To facilitate the Committee meetings and streamline its function, staff recommends the adoption of Committee By-Laws (Attachment A).  The By-Laws are similar to By-Laws for other advisory committees previously established by the Board.  The advisory committee shall provide advice and guidance on the operations, maintenance and budgetary issues related to the approved services for the EGCSD as follows:

 

a.                     Maintenance of perimeter County roads;

b.                     Drainage, stormwater, and flood control systems in the public rights-of-way;

c.                     Lincoln Park; and

d.                     Open Space.

 

Supervisor Parker’s office will make recommendations for appointments to the Board of Supervisors.  Community outreach efforts will include sending emails to East Garrison residents and announcement postings on the East Garrison chapter of NextDoor (a neighborhood networking online services), as well as Supervisor Parker’s Facebook and website pages.

 

FINANCING:

There is no impact to the General Fund.  CSD assessments for EGCSD will be used to fund staff costs associated with the creation and ongoing operations of the committee.  Staff activities shall include, but not be limited to, preparation of meeting notices, attendance and minutes at the meetings, research, analysis and reporting on committee requests and recommendations.  The annual cost to staff the Committee will vary depending on the level of requests by the committee members.

The creation of and activity of the Advisory Committee meets Board of Supervisor Strategic Initiatives related to administration, infrastructure and public safety.
