a. Authorize the Director of the Information Technology Department to execute a non-standard Agreement with Federal Engineering, Inc. to provide microwave backhaul upgrade assessment, design, and consulting services, for the period October 17, 2017 through October 16, 2020 for a total contract amount of $587, 233;
b. Accept non-standard contract provisions as recommended by the Director of the Information Technology Department; and
c. Authorize the Director of the Information Technology Department to sign up to two (2) amendments to this Agreement, extending the term by one (1) year per amendment, where the increase in the amount of each amendment does not exceed ten percent of the original cost ($58,723.30 maximum increase per amendment) and where the amendments do not significantly change the scope of work and do not alter the non-standard terms of the Agreement.

RECOMMENDATION:
It is recommended that the Board of Supervisors:
a. Authorize the Director of the Information Technology Department to execute a non-standard Agreement with Federal Engineering, Inc. to provide microwave backhaul upgrade assessment, design, and consulting services, for the period October 17, 2017 through October 16, 2020 for a total contract amount of $587,233;

SUMMARY:
Federal Engineering, Inc., was selected as the most qualified vendor to perform assessment, design and consulting services through a competitive bidding process. Federal Engineering, Inc. will be responsible for Phase I of the Microwave Backhaul Upgrade Assessment, Design, and Consulting Services project and will provide project initiation to include needs assessment and requirements, preliminary system design, Scope of Work/RFP development for construction, construction procurement process project management, and implementation project management.
DISCUSSION:
The County’s microwave network supports network, telecommunications, and radio communications for public safety first responders and 911 dispatch traffic either as a primary or redundant path. The microwave network is currently outdated and out of warranty. The current system is maintained with refurbished parts and needs to be upgraded to properly support forthcoming upgrades in the technologies that will require microwave support.
In its Request for Quote (RFQ), the Information Technology Department (ITD) announced that the County was seeking services from vendors experienced in delivering assessment, design, consulting services, and construction management for the upgrade of an existing enterprise and public safety grade microwave system. The RFQ established that desired services include an FCC frequency availability analysis for microwave links to be included in the refreshed topology, and development of a scope of work with detailed specifications to be integrated into the County’s planned Request for Quotation (RFQ) for implementation and construction of the upgrade design.
County objectives include improving existing County services through deployment of scalable, robust, manageable, high performance public safety grade microwave solutions. Solutions shall establish a standardization of equipment and enhance the County microwave systems’ reliability, availability, and alleviate single points of failure via implementation of proven microwave technologies. An assessment and analysis of the County’s infrastructure, topology, and geography shall result in a microwave strategy plan which identifies where decommissioning, upgrade(s), replacement(s), and/or new microwave systems are proposed and how the County can migrate to the new microwave systems while minimizing operations/downtime for the said microwave links.
OTHER AGENCY INVOLVEMENT:
County Counsel has reviewed the agreement with Federal Engineering and cannot approve due to the following non-standard terms: non-standard termination provisions and non-standard indemnification provisions. Risk does not approve non-standard indemnification provisions.
FINANCING:
This request is a part of ITD CIP projects, and funds for this expense have been included in the FY 17-18 Adopted Budget for the Information Technology Department, 1930, Unit 8436, Appropriation unit INF002.
BOARD OF SUPERVISORS STRATEGIC INITIATIVES:
Professional design of a public safety grade microwave backhaul is the first step in upgrading the aged system with a robust, highly available microwave system. The upgrade will ensure that Monterey County and first responders’ communication systems are reliable, and will enable the support of existing and future technologies for many years to follow.
