a. Approve and authorize the Contracts/Purchasing Officer or Contracts/Purchasing Supervisor to execute an Agreement with Motorola Solutions, Inc., for the leasing of forty (40) radios, for the time period of November 1, 2017 through October 31, 2022, in the maximum amount of $141,200.00 for the Monterey County Adult Correction Facility;
b. Accept non-standard contract provisions as recommended by the Sheriff;
c. Authorize the Contracts/Purchasing Officer or Contracts/Purchasing Supervisor and the Sheriff to sign and execute the appropriate documents and verifications when required;
d. Authorize the Contracts/Purchasing Officer or Contracts/Purchasing Supervisor to issue purchase orders on an as-needed basis pursuant to this Agreement over the period of November 1, 2017 to October 31, 2022.

RECOMMENDATION:
It is recommended that the Board of Supervisors:
a. Approve and authorize the Contracts/Purchasing Officer or Contracts/Purchasing Supervisor to execute an Agreement with Motorola Solutions, Inc., for the leasing of forty (40) radios, for the time period of November 1, 2017 through October 31, 2022, in the maximum amount of $141,200.00 for the Monterey County Adult Correction Facility;
b. Accept non-standard contract provisions as recommended by the Sheriff;

SUMMARY:
It is requested that the Board of Supervisors authorize the Contracts/Purchasing Officer or Contracts/Purchasing Supervisor to sign a non-standard Agreement with Motorola Solutions, Inc., and to issue purchase orders on an as-needed basis, in the aggregate amount not to exceed $141,200.00, over the period November 1, 2017 to October 31, 2022. The Adult Correction Facility requires radios capable of transmitting and receiving on the 700 MHz frequency range.
DISCUSSION:
The Corrections Support staff at the Adult Corrections Facility requires radios that can transmit and receive on the 700 MHz frequency range. The new County-wide NGEN radio system requires that the entire Corrections staff have radios on this frequency range. The older radios presently deployed can transmit and receive only on the VHF frequency range.
Upgrading these radios was part of the adoption plan for the NGEN system, because it creates a closed 700 MHz system only at the jail, and reduces traffic overloading on the NGEN system.
The proposed Agreement is non-standard for the County, but is based upon the Vendor’s
standard agreement and leasing terms.
The County must submit a fully executed Exhibit E to Motorola Solutions, Inc., and the final version of Exhibit D will be prepared by Motorola Solutions, Inc. and completed as authorized above.
A copy of this lease agreement is on file with the Clerk to the Board.
OTHER AGENCY INVOLVEMENT:
Your Board recently approved an identical lease agreement on behalf of the District Attorney’s Office on the October 10, 2017 Board of Supervisors agenda. Risk Management is unable to approve the agreement, because Motorola will not provide insurance. County Counsel has approved the agreement as to form. This is a non-standard lease agreement, and the Sheriff is requesting approval because it is operationally necessary to replace the older radios, all of which are past useful life.
FINANCING:
The first payment due under this Lease is due in Fiscal Year 2018-19, in the amount of $28,203.87. This payment, and the four subsequent annual payments of $28,203.87 ($141,019.35 total) will be incorporated as part of the subsequent years’ budget development process. No General Fund Contribution increase for FY 2017-18 will result from approval of this lease agreement.
