Report

RECOMMENDATION:

It is recommended that the Board of Supervisors:

a.                     Award a contract to A. Teichert & Son, dba Teichert Construction, the lowest responsible bidder, for the State Route 1 Climbing Lane, Project No. 8690, in the total amount of $4,731,210;

b.                     Approve the Performance and Payment Bonds executed and provided by A. Teichert & Son, dba Teichert Construction;

c.                     Authorize a contingency, not to exceed 10% of the contract amount or $473,121, to provide funding for approved contract change orders;

d.                     Authorize the Resource Management Agency Director or Resource Management Agency Deputy Director of Public Works & Facilities to execute the contract and, subject to the terms of the Public Contract Code, approve change orders to the contract that do not exceed 10% of the original contract amount and do not significantly change the scope of work; and

e.                     Authorize the RMA Director or RMA Deputy Director of Public Works & Facilities to execute a Certificate of Completion and record a Notice of Completion with the County Recorder when the Director or Deputy Director determines that the contract is complete in all respects in accordance with Plans and Special Provisions for the construction of the State Route 1 Climbing Lane, Project No. 8690, A. SUMMARY:

Approval of the recommended action will authorize the Resource Management Agency (RMA) to award the State Route 1 Climbing Lane project construction contract to A. Teichert & Son, dba Teichert Construction (Teichert Construction) and proceed with construction.  In general, the project consists of constructing a second northbound through lane (climbing lane) on the east side of State Route 1 between Rio Road and Carmel Valley Road.

 

DISCUSSION:

The purpose of the project is to improve traffic flow on State Highway 1 between Rio Road and Carmel Valley Road by constructing a northbound climbing lane on State Highway 1. The project consists, in general, of constructing a second northbound through lane (climbing lane) on the east side of State Route 1 between Rio Road and Carmel Valley Road.  The project will also upgrade the wooden signal poles at the intersection of State Route 1 and Carmel Valley Road.

 

On August 29, 2017, the Board of Supervisors approved the Plans and Special Provisions for the State Route 1 Climbing Lane, Project No. 8690.  The project was subsequently advertised and bids were opened on October 6, 2017.  The lowest responsible, responsive bidder was Teichert Construction.  However, Teichert Construction’s bid submittal of $5,055,885 contained a clerical error; the correct amount is $4,731,210.  In consultation with the Office of the County Counsel, Teichert Construction was notified that the County of Monterey (County) can only award the construction contract in the correct amount of $4,731,210.  Teichert Construction was given the option to withdraw their bid or perform the work for the amount of $4,731,210.  Teichert Construction agreed to perform the work for the amount of $4,731,210.

 

This amount is over the Engineer’s estimate of $3,585,392 by $1,145,818.  In collaboration with the Transportation Agency for Monterey County (TAMC), the County was able to secure the needed additional funds, in the form of Regional Surface Transportation Program (RSTP) funds, to fully fund the construction phase of the project.

 

In compliance with the California Environmental Quality Act (CEQA), Caltrans and the County working together, prepared a Mitigated Negative Declaration (MND) and an addendum to the MND.  Caltrans adopted the MND in April 2012 and the addendum in February 2017.  On February 23, 2017, the Zoning Administrator of the County of Monterey considered the MND and addendum, and adopted the Mitigation Monitoring and Reporting Program (MMRP).  On October 24, 2017, the Board of Supervisors certified that on February 23, 2017, the appropriate authority of the County of Monterey considered the environmental effects of the project and adopted the MMRP as shown in the MND adopted by Caltrans in April 2012 and in the Addendum adopted by Caltrans in February 2017.

 

Construction is anticipated to begin in December 2017.

 

 

OTHER AGENCY INVOLVEMENT:

The Office of the County Counsel, and Contracts/Purchasing, attended the bid opening and reviewed the low bid for conformance with applicable regulations.  The Office of the County Counsel, Auditor-Controller, and Risk Management, have reviewed and approved the Contract and Bonds as to form, fiscal terms, and insurance provisions, respectively.

 

FINANCING:

The total estimated project cost, including engineering, environmental, right-of-way and construction is $7,099,309.  Funding from a variety of State and local revenue in the amount of $7,099,309 has been authorized for design, environmental, right-of-way and construction for the project.  Local revenue is comprised of Regional Surface Transportation Program (RSTP) in the amount of $3,364,814 and development fees in the amount of $209,494.  The estimated cost for FY 2017-18 for construction management and construction contract is $5,821,996.  There are sufficient appropriations adopted in the FY 2017-18 Road Fund 002, Appropriation Unit RMA012 budget to finance the construction phase of the project.  The project is expected to be completed in FY 2017-18.

 

BOARD OF SUPERVISORS STRATEGIC INITIATIVES:

The project is to construct an improvement to the transportation infrastructure that will reduce traffic travel times and increase safety on State Route 1 between Carmel Valley Road and Rio Road.  The recommended action supports the following Board of Supervisors’ Strategic Initiatives:
