RECOMMENDATION:

It is recommended that the Board of Supervisors:

 

a.   Approve Amendment No. 8 to Professional Services Agreement No. A-11286 with Wood Rodgers, Inc. to provide additional tasks associated with project management, final plans, specifications and engineer’s estimate, preparation of regulatory permits/applications, preparation of the Project Study Report/Project Report, assistance during bidding, assistance during construction and additional services for the Monterey Bay Sanctuary Scenic Trail -  Moss Landing Segment, County Project No. 8668, to increase the not to exceed amount of $1,819,408 by $377,660 for a total amount not to exceed $2,197,068, with no extension to the term of the Agreement from October 1, 2008 to June 30, 2022; and

 

b.   Authorize the Contracts/Purchasing Officer or Contracts/Purchasing Supervisor to execute Amendment No. 8 to Professional Services Agreement No. A-11286 and future amendments that do not significantly alter the scope of work or change the approved Agreement amount.

 

SUMMARY:

Approval of Amendment No. 8 to Professional Services Agreement (PSA) No. A-11286 with Wood Rodgers, Inc. (WRI) will allow the Resource Management Agency (RMA) to retain professional services with WRI to provide additional tasks associated with the preparation of the Project Report as required by the California State Department of Transportation (Caltrans).  Other tasks include project management; preparation of final Plans, Specifications and Engineer’s Estimate (PS&E); assistance in obtaining various regulatory permits; and assistance during bid time and construction of the project.

 

DISCUSSION:

The Monterey Bay Sanctuary Scenic Trail Project (Project) proposes to construct a bicycle / pedestrian path along State Route 1, from Moss Landing Road to the north side of Elkhorn Slough, near the community of Moss Landing.  The path is approximately 0.86 of a mile long and includes constructing a 12 feet wide bridge, approximately 386 feet long over Elkhorn Slough.

 

The project has been on hold due the lack of funds for the construction phase.  Prior to this, RMA staff progressed through the environmental phase of the Project with adoption of a Mitigated Negative Declaration and the Mitigation and Monitoring Reporting Program in September 2015.  Staff has completed ninety percent (90%) of design and is moving forward on the right-of-way and permitting phase of the Project.  Staff has applied twice for the Active Transportation Program (ATP) grant (in 2015 and 2016) to fully fund the construction phase of the Project but was not chosen both times.

 

The California Transportation Commission (CTC) adopted the 2017 ATP Augmentation with the recent passage of Senate Bill 1.  This augmentation would fund projects that were submitted in the 2017 ATP cycle.  Projects submitted in the 2016 ATP cycle that received a score of 74 and demonstrated a potential to increase walking and biking were recommended for the grant for the Small Urban & Rural Component.  The Project received a score of 74 and was included in the list of new projects to be funded by the 2017 ATP Augmentation.

 

Based on current estimates, the grant would provide sufficient funds to continue into the construction phase.  Staff is working with Caltrans and TAMC to complete the design of the Project and acquire the necessary easements and permits prior to construction.  Additional costs could occur depending on property negotiations and costs from regulatory agencies (permits, design modifications, mitigation).  Construction of the project is anticipated to begin in summer 2020.

 

Professional services from WRI are needed to prepare the Project Report for the project as required by Caltrans; complete design; and obtain the various regulatory permits required for the project.

 

Amendment No. 8 to the PSA with WRI will increase the not to exceed amount of $1,819,408 by $377,660 for a total amount not to exceed $2,197,068, with no extension to the term of the Agreement which is October 1, 2008 to June 30, 2022.

 

Attachment L provides a summary of the PSA to date.  Attachment M provides a summary of the PSA annual expenditures and balance.

 

The Monterey Bay Sanctuary Scenic Trail (MBSST); Moss Landing Segment project (Moss Landing Segment) is a segment of the MBSST Master Plan, dated July 2007.  The Master Plan was developed by the Transportation Agency for Monterey County (TAMC) in collaboration with public agencies, nonprofit organizations and the public to construct a trail to allow people to bicycle around Monterey Bay from Lovers Point in Pacific Grove to Wilder Ranch in Santa Cruz.  The primary purpose of the trail is to enhance appreciation and protection of the Monterey Bay National Marine Sanctuary by promoting public use and enjoyment at its shoreline.  Since the Moss Landing segment is under the jurisdiction of the County, the County is the Project sponsor responsible for designing, constructing, and managing the segment.

 

OTHER AGENCY INVOLVEMENT:

The Office of the County Counsel and Auditor-Controller’s Office have reviewed and approved Amendment No. 8 as to form and legality, and fiscal provisions, respectively.

 

FINANCING:

The total estimated project cost, including engineering, environmental, right-of-way and construction is $13.7 million.  Expenditures incurred from Fiscal Year 2008 to the current year total $2.6 million.  The remaining $11.1 million is expected to be expended over the next three fiscal years.  The project is funded by various Federal, State and grant funding sources:  Safe, Accountable, Flexible, Efficient and Transportation Equity: A Legacy for Users (SAFETEA-LU); gas tax; Measure X; 2% Transportation Development Act (TDA); Active Transportation Program (ATP); and Coastal Conservancy Grant.

 

RMA was informed that the ATP grant funds will not be affected if Senate Bill 1 is repealed in November 2018, because the Project is already included in the list of new projects to be funded by the 2017 ATP Augmentation.

 

Amendment No. 8 will be fully funded through SAFETEA-LU with sufficient appropriations in Fiscal Year 2017-18 available in the RMA - Public Works Budget (Fund 002, Appropriation Unit RMA012, Unit 8195).
