RECOMMENDATION:
It is recommended that the Monterey County Water Resources Agency Board of Directors recommend the Monterey County Water Resources Agency Board of Supervisors:

a. Approve a Quitclaim Deed for an eighty-foot-wide Easement near Bryant Canyon Rd in Soledad; and,
b. Authorize the General Manager to execute the quitclaim deed upon approval as to form by County Counsel.

SUMMARY/DISCUSSION:
The Monterey County Water Resources Agency (MCWRA) received an easement in 1996 within their Zone 8 for a Bryant Canyon Channel Improvement Project. Prior to commencement of construction in 2002, it was determined that a portion of the proposed channel needed to be relocated near the Bryant Canyon Road undercrossing and a new easement would be necessary for that portion of the Project. UCP Soledad LLC completed construction of the Bryant Canyon Channel Improvement Project in October 2017 per the approved Subdivision Improvement Agreement. A survey was conducted to determine the exact legal description necessary for a new permanent easement. The new easement was recorded in June 2017. The City of Soledad will receive the remainder parcel which includes the easement recorded in 1996. They are requesting that the MCWRA quitclaim the original easement since a new one has been received by MCWRA and the Channel Improvement Project is completed.

OTHER AGENCY INVOLVEMENT:
County Counsel will review the Quitclaim Deed.
