a. Consider an appeal filed by General Farm Investment (Chris Bunn) from the denial by the Monterey County Health Department of the application for a Water Well Construction Permit (#17-12916); and
b. Direct and and authorize the Monterey County Health Officer or their designee to issue a Replacement Water Well Construction Permit (#17-12916) with conditions recommended by the Monterey County Water Resources Agency.

RECOMMENDATION:
It is recommended that the Board of Supervisors adopt a resolution (Attachment A) to:
a. Consider an appeal filed by General Farm Investment (Chris Bunn) from the denial by the Monterey County Health Department of the application for a Water Well Construction Permit (#17-12916); and
b. Direct and authorize the Monterey County Health Officer to issue a Replacement
Water Well Construction Permit (#17-12916) with conditions recommended by the Monterey County Water Resources Agency.
SUMMARY:
On February 13, 2018, the Monterey County Board of Supervisors conducted a public hearing on an appeal filed by General Farm Investment of the Monterey County Health Department's denial of an application for a Water Well Construction Permit (#17-12916). At the conclusion of the hearing, the Board of Supervisors adopted (by 3-2 vote) a motion of intent to grant the appeal and approve the well permit as a replacement well and continued the Public Hearing to February 27, 2017 to allow for staff to return with a resolution for approval and recommended conditions of approval. On February 27, 2018, staff requested a continuance of the public hearing to allow sufficient time for staff to return with a resolution, and the Board continued the hearing to March 13, 2018.
