Authorize the Contracts/Purchasing Officer or the Contracts/Purchasing Supervisor, the Director of Health or Assistant Director of Health, the Director of Department of Social Services, and the CEO of Natividad to sign up to three (3) no-extension, substantive amendments to the MOU, subject to review and approval of County Counsel and County Risk Management.

RECOMMENDATION:

It is recommended that the Board of Supervisors:

a. Approve and authorize the Contracts/Purchasing Officer or Contracts/Purchasing Supervisor to sign a Memorandum of Understanding (MOU) with the Monterey County Children and Families Commission DBA First 5 Monterey County and other named parties, for the initial term of March 20, 2018 to June 30, 2019, automatically extending for one-year periods and setting forth the parties’ obligations, as collaborators in a Multi-Disciplinary Team (“MDT”) within an integrated children services program, for the sharing of information and/or records relevant to the provision of those services and for the establishment of a common database for the purposes of delivering services under this program; and

b. Approve and authorize the Director of Health or Assistant Director of Health to sign the MOU; and

c. Approve and authorize the Director of Department of Social Services to sign the MOU; and

d. Approve and authorize the Chief Executive Officer (“CEO”) of Natividad Medical Center (“Natividad”) to sign the MOU; and

SUMMARY/DISCUSSION:

F5MC is a local governmental agency formed pursuant to the California Children and Families Act (Health and Safety Code section 130100, et seq.) and dedicated to the health and wellness of children ages 0-5 and their families. To carry out its mandates, F5MC and the County of Monterey desire to work with various governmental agencies, non-profit organizations, and individuals to provide screening and/or assessment referrals, as well as treatment to children and their families (the “Services”) through a multi-disciplinary team (referred to hereinafter as a “MDT”). F5MC desires to implement MDT’s by working with the Collaborators, who in some instances are already providing the Services in Monterey County but not necessarily as part of an MDT.

 

California Welfare and Institutions Code section 18986.46 allows members of an MDT within an integrated children services program to share information and/or records relevant to the provision of those services and to establish a common data base for the purposes of delivering services under this program. The County of Monterey collaborates in the MDT through the participation of the County Health Department, the County Department of Social Services, and Natividad Medical Center.

 

In order to provide the most complete Services to children and their families (known herein as the “Participants”), the MDT must share information in a manner consistent with state and federal law, including, but not limited to, California Welfare & Institutions Code section 18986.46.  This statute allows members of an MDT to share information relevant to the provision of the Services to the Participants if such information is shared in a manner consistent with California law.  Additionally, Health and Safety Code section 130140.1(e) allows F5MC to share certain information consistent with state and federal law, and only to the extent necessary to the provision of the Services.

 

By executing this MOU, the parties desire to comply with the provisions contained in California Welfare & Institutions Code section 18986.46(j), which requires the MDT to specify the types of information that may be shared with and without a signed consent form and the process used by the Parties to ensure that current confidentiality requirements are met, including but not limited to obtaining a consent form by the Participants or the parents, legal guardian or judicial officer with jurisdiction over the Participant.

 

The MOU shall be extended automatically for one-year periods. This ensures that for the entire term of the MOU, the signatories will be continually obligated to share information in a manner consistent with state and federal law.

 

Early childhood development has been identified by both the Board of Supervisors and the Monterey County Children's Council as critical for the economic and social success of our county.  Investments in quality early childhood development programs bring returns of 10-17% to the economy in the form of increased income and tax revenues as well as reductions in remedial programs and justice system expenditures.  The California State Association of Counties (CSAC) recognized the critical importance of early childhood development programs and named 2013 as the Year of the Child.  This MOU will provide support for upstream prevention programs for children and families.

 

The Board of Supervisors identified early childhood development as a priority in the Monterey County Legislative Program 2013-2014. This action will allow First 5 Monterey County to support the local Collaborative Action Teams as they move through their Action Plans that include strategic Outreach and Capacity Building, and activities related to Implementing, Improving and Expanding.

 

This action will support the Monterey County Health Department’s 2011-2015 Strategic Plan Initiatives: 1. Empower the community to improve health through programs, policies, and activities; 2. Enhance community health and safety by emphasizing prevention; 3. Ensure access to culturally and linguistically appropriate, customer-friendly, quality health services.

 

OTHER AGENCY INVOLVEMENT:

County Counsel and the Auditor-Controller have reviewed and approved as to legal form and fiscal provisions respectively. County Risk Management has reviewed but not approved the non-standard risk provisions.

 

FINANCING:

There is no fiscal impact on the General Fund Budget.
