Direct the Clerk of the Board’s Office to post a vacancy to represent the public on the Countywide Oversight Board, in compliance with the requirements of the Maddy Act (Government Code §54970 et seq.).

RECOMMENDATION:

It is recommended that the Board of Supervisors direct the Clerk of the Board’s Office to post a vacancy to represent the public on the Countywide Oversight Board, in compliance with the requirements of the Maddy Act (Government Code §54970 et seq.).

 

SUMMARY/DISCUSSION:

Pursuant to the Dissolution Act, (Health and Safety Code, §§ 34161, et seq.), redevelopment agencies were dissolved, effective February 1, 2012, and replaced with individual “successor agencies”, that reported to its own Oversight Board, charged with winding down the operations of the former redevelopment agencies. 

 

Pursuant to Health and Safety Code (HSC) Section 34179(j), effective July 1, 2018, in each county where more than one oversight Board was created, there shall be only one Countywide Oversight Board. In Monterey County, there are ten Successor Agencies with their individual Oversight Boards: 1) The County of Monterey, and nine Cities, 2) Gonzales, 3) Greenfield, 4) King, 5) Marina, 6) Monterey, 7) Salinas, 8) Sand, 9) Seaside, and 10) Soledad. The current oversight boards will dissolve and will no longer have bearing on Successor Agency actions. 

 

The Countywide Oversight Board will be comprised of seven members.  Two members will be appointed by the Board of Supervisors, one representing the County and the other position representing the public. Each appointing entity may appoint an alternate member with the same voting rights as the primary member, but an alternate is not required. Members will serve at the pleasure of their respective entities. The Governor may appoint individuals to fill any oversight board member position that has not been filled by July 15, 2018, or any member positions that remains vacant for more than 60 days.

 

The oversight board is appointed as follows:

 

 Membership of the Countywide Oversight Board

1.                     One member appointed by the county board of supervisors,

2.                     One member appointed by the city selection committee,

3.                     One member appointed by the independent special district selection committee,

4.                     One member appointed by the county superintendent of education to represent schools if the superintendent is elected,

5.                     One member appointed by the Chancellor of the California Community Colleges to represent community college districts in the county,

6.                     One member of the public appointed by the county board of supervisors,

7.                     One member appointed by the recognized employee organization representing the largest number of successor agency employees in the county.

 

To date, the following appointments have been made by their respective entities to serve on the Countywide Oversight Board:

 

1.                     Mike LeBarre, Mayor, City of King (representing city selection committee).

2.                     Warren E. Poitras. (representing the independent special district selection committee - LAFCO).

3.                     Benjamin Figueroa, Vice President of Administrative Services, Hartnell CCD (representing the California Community Colleges District).

 

Staff will return to the Board with the recommended Board Appointments, once the requirements of the Maddy Act have been met.

 

OTHER AGENCY INVOLVEMENT:

The Successor Agencies support this recommendation.  The office of the Successor Agency Counsel has reviewed this report as to form and legal effect.

 

FINANCING:

Administrative costs associated with this recommendation will be reimbursed by the Office of the Auditor-Controller, from Redevelopment Property Tax Trust Funds (RPTTF). There are no additional fiscal impacts with this recommendation.
