RECOMMENDATION:

It is recommended that the Board of Supervisors:

a. Approve and authorize the Director of Information Technology to execute a non-  standard Agreement with Applied Geographics, Inc. for the purchase of one Google Imagery License and one (1) year of technical support, for a total contract amount not to exceed $46,736 for the period of July 1, 2018 to June 30, 2019; and

b. Authorize the Director of Information Technology to sign up to four (4) amendments to this Agreement, extending the term by one year each, where the additional costs per year do not exceed ten percent (10%) of the cost of the prior year, subject to County Counsel review, and provided that the terms and conditions of the agreement remain substantially the same; and

SUMMARY/DISCUSSION:

Geographic Information System (GIS) aerial imagery is used by many County Departments to serve the residents of Monterey County.  Aerial imagery provides photographic verification of existing conditions at a given location at a specific time. For example, both the Resource Management Agency and the Assessor need current imagery to inspect for code enforcement issues or to determine if non-permitted structures are present and can assess accordingly.

 

The ability to prioritize this work from a computer, rather than conduct wandering searches of a region saves time and money for the County. Another example is in the event of a disaster, e.g., major fire, earthquake or flood, the updated imagery will provide a current photo of the impacted area and allow for quicker and more effective deployment of resources, and later helps assist property owners needing to document their losses for insurance/disaster relief.

 

OTHER AGENCY INVOLVEMENT:

County Counsel has reviewed the proposed Agreement and cannot approve due to the following non-standard terms: imposition of County liability for third-party breach of obligations, including confidentiality breaches, vendor’s right to change the terms of service, upon notice, non-standard payment terms (lump sum), shortened statute of limitations, vendor’s right to suspend service, non-standard termination provisions, disclaimer and limitation of warranty, limitations on types of vendor liability and the amount of liability to amount of the contract, requirements for County to defend and indemnify vendor, and non-standard venue provisions.

 

FINANCING:

Funding for this agreement has been included in the FY 2018-19 Recommended Budget for the Information Technology Department, ITD 1930, Budget Unit 8433, Appropriations Unit INF002.

 

BOARD OF SUPERVISORS STRATEGIC INITIATIVES:

The Board’s approval of this agreement will heighten the efficiency and effectiveness of the County’s code enforcement and building permitting efforts.  The Board’s approval of this agreement will enable the County to effectively deploy resources in the event of a disaster, thereby enhancing public safety.
