RECOMMENDATION:
It is recommended that the Monterey County Water Resources Agency Board of Directors:

a. Approve a Notice of Completion for the repair of the ZO pipeline of the Castroville Seawater Intrusion Project; and
b. Authorize the General Manager to execute and record the Notice of Completion at the Monterey County Recorder's Office.

SUMMARY/DISCUSSION:
All work pertaining to the repair of the ZO pipeline of the Castroville Seawater Intrusion Project was completed on May 22, 2018. The work was inspected by Agency staff and determined to meet bid agreement requirements. Article 2, of the bid agreement requires a Notice of Completion be completed and recorded by the Monterey County Recorder. Recordation of a Notice of Completion limits filing of stop payment notices (the process for parties under the prime contractor to dispute a payment to them from the prime contractor), to 30 days after the date of recordation. If stop payment notices are not received during that period, the final amount of retention held on the bid agreement will be released to the prime contractor. If a stop payment notice is received, the amount of the stop notice is withheld by the Agency from the retained amount until the payment dispute between the stop notice filing party and the prime contractor is resolved. The prime contractor for this work was The Don Chapin Co., Inc. There is no cost to the Agency regarding this action.
