RECOMMENDATION:
It is recommended that the Monterey County Water Resources Agency Board of Directors:
Suspend Agency Land access until the Agency Land Access Policy is completed and approved by the Agency Board of Directors.
SUMMARY/DISCUSSION:
Currently, Agency staff is working on a dozen requests for access across Agency land. Some of the requests have no prior documentation however for other requests staff has been finding historic records that may indicate access was contemplated. These access requests include easements, licenses and encroachments. The Agency Land Access Policy would cover all these types of requests. Staff has been taking each request before the Agency Board of Directors’ Personnel and Administration Committee (P&A Committee). At the June 1, 2018, P&A Committee meeting, staff was directed to prepare a Resolution declaring an Agency Land Access Moratorium. In discussion with County Counsel it was determined that this Board Action was sufficient.
Staff anticipates that the policy will take several months to complete due to resource shortages. The P&A Committee will be provided monthly progress updates.
OTHER AGENCY INVOLVEMENT:
Staff has been working directly with County Counsel and their staff.

There is no cost to this action.
