RECOMMENDATION:

It is recommended that the Board of Supervisors:

a.                     Approve and Authorize the Sheriff or Undersheriff to sign a two (2) year Memorandum of Understanding (MOU) with the California Department of Justice (Agreement DOJ-PROP56-2017-18-1-013) for a Tobacco Law Enforcement Grant in the amount of $667,349 for the period from June 1, 2018 to June 30, 2020;

b.                     Adopt a Resolution to accept this grant, and any additional funding allocated, as required by MOU guidelines and grant documents;

c.                     Add one (1.0) FTE Deputy Sheriff-Enforcement to the Sheriff’s Office Budget Unit 001-2300-SHE001-8250 (Community Services) (4/5th vote required);

SUMMARY:

On June 27, 2018, the Budget Committee supported to submit this report to the full board. 

 

In May 2018, we presented your board a request to apply for a Law Enforcement Tobacco grant and we have been awarded a grant in round one of the funding, for the $667,349.00 amount that was submitted. The grant was divided into two parts - enforcement and educational activities.

 

A full-time Tobacco Enforcement Deputy has been built into the grant to focus on retail tobacco regulations enforcement and education. This deputy will be aided by our youth Explorer Unit, and they will assist the deputy in performing retail tobacco surveys to prevent the sale of tobacco and vaping products to persons under the age of twenty-one. The Monterey County Retail License Ordinance is dependent on repeated, frequent citations for sales to minors to move a retailer into a category where they pay progressively larger fines, or risk having their license being suspended temporarily or permanently.

 

The educational focus of this grant is on vaping, and in specific, the JUUL® nicotine delivery system. This product delivers a particularly concentrated dose of nicotine, and is considered so harmful that it has been banned in Europe.  In Monterey County, the product is available in gas stations, grocery stores and markets. Nationwide, JUUL® has garnered a fifty percent market share among all vaping products. The Sheriff’s Office will use a combination of the Tobacco Enforcement deputy, School Resource Officer and Crime Prevention Specialist time to provide presentations to parents, schools, and the many community groups that the Sheriff’s Office interacts with, to educate the public as to how harmful vaping and other tobacco products are.

 

A copy of the grant budget and the MOU are on file with the Clerk of the Board.

 

County Counsel has approved the agreement as to legal form, the Auditor-Controller has reviewed as to fiscal provisions, the County Administrative Office reviewed the report and Human Resource Department concurs with the recommendation. The Health Department, Tobacco Control Unit has been of great assistance in formulating this grant.

 

FINANCING:

The grant is a reimbursement grant and the amount of the grant award is a maximum amount. The grant will be monitored to achieve maximum revenue generation. The budget for FY 2018-19 is $341,534.00 and the FY 2019-20 budget is $325,815.00, for a total grant award of $667,349.00.
