RECOMMENDATION:

 

It is recommended that the Board of Supervisors:

 

a.                     Approve and authorize the Director of Health or Assistant Director of Health to execute a Mental Health Services Agreement for the term retroactive to October 1, 2017 to June 30, 2020 with Kids Behavioral Health of Alaska, Inc. DBA Copper Hills Youth Center for the provision of mental health and residential services in the amount of $109,533 for Fiscal Year (FY) 2017-18, $216,883 for FY 2018-19, and $216,883 for FY 2019-20, for a total Agreement amount not to exceed $543,299; and

 

b.                     Accept the recommendation of the Director of Health or Assistant Director of Health to approve the non-standard insurance provisions in the Agreement; and

 

c.                     Approve and authorize the Director of Health or Assistant Director of Health to approve up to three (3) future amendments that do not exceed ten percent (10%) ($54,330) of the original Agreement amount and do not significantly change the scope of services.

 

SUMMARY/DISCUSSION:

 

Kids Behavioral Health of Alaska, Inc. DBA Copper Hills Youth Center, located in West Jordan, Utah, is a therapeutic residential treatment center that specializes in working with adolescents with behavioral, emotional, and mental health disorders that interfere with their ability to effectively function within their home and in the community.  Copper Hills Youth Center residential treatment program provides 24-hour supervision and mental health services that include individual counseling, group counseling, recreation group therapy, and family counseling. 

 

The term of this Agreement is retroactive to October 1, 2017 due to an emergency placement of a Monterey County youth in accordance with the youth’s individual treatment plan (IEP).  An emergency placement occurs when the individual is presenting with behaviors that place themselves or others at risk of harm, and can no longer be kept safe in the home and school environments.   Copper Hills Youth Center was the only residential facility with specialized mental health treatment that accepted placement of the youth.  Presentation of this Agreement to the Board was delayed because Copper Hills Youth Center did not and ultimately would not meet all of the County’s standard insurance requirements. Copper Hills has provided a letter of self-insurance in lieu of commercial general liability coverage, but has not provided endorsements naming the County as an Additional Insured and providing that such self-insurance is primary and non-contributory. The Health Department requests that the Board accept the Director of Health’s recommendations to accept the non-standard insurance provisions in this Agreement, due to the unique services that only this residential facility can provide.

 

This Agreement contains the County’s standard 30-day “no cause” provision (Section IV, B) and an additional defunding provision (Section IV, D), which provides the County the ability to amend or terminate the Agreement in the event of a reduction and/or termination of funding. 

 

This work supports the following Monterey County Health Department 2011-2015 Strategic Plan initiative: 3) Ensure access to culturally and linguistically appropriate, customer-friendly, quality health services.  It also supports one of the ten essential public health services, specifically: 7) Link people to needed personal health services and assure the provisions of health care when otherwise unavailable.

 

OTHER AGENCY INVOLVEMENT:

 

County Counsel and Auditor-Controller have reviewed and approved this Agreement as to legal form and fiscal provisions, respectively. Risk Management has not approved this Agreement due to non-standard insurance provisions. 

 

FINANCING:

 

This Agreement is 100% funded by Special Education Local Plan Area (SELPA) funds that pay for children who are placed through the IEP.  The funds for this Agreement ($109,533) are included in the Health Department Behavioral Health (HEA012, Unit 8410) Fiscal Year (FY) 2017-18 Adopted Budget.  The funds for this Agreement for FY 2018-19 ($216,883) and FY 2019-20 ($216,883) will be included in the respective Health Department Behavioral Health (HEA012, Unit 8410) FY 2018-19 and FY 2019-20 Requested Budgets.
