RECOMMENDATION:

It is recommended that the Board of Supervisors:

a.                       Conduct a Public Hearing to take comments on the 3rd Amendment to

the Consolidated Plan which reflects changes in Urban County Jurisdictional partners;

b.                       Approve a Resolution to enter into a Joint Exercise of Powers Agreement and Cooperative Agreement to Undertake or to Assist in the Undertaking of Essential Activities Pursuant to Title I of the Housing and Community Development Act of 1974, as Amended, with the cities of Del Rey Oaks, Gonzales, Greenfield, and Sand City to participate in the CDBG program for the period of July 1, 2019 to June 30, 2022;

SUMMARY:

Program Year 2019, which begins on July 1, 2019, marks the beginning of the third three-year cycle that the County of Monterey will qualify as a U.S. Department of Housing and Urban Development (HUD) Urban County.  Designation as an Urban County allows Monterey County to receive Community Development Block Grant (CDBG) funds directly from HUD.  The recommended action will amend the Consolidated Plan to include Del Rey Oaks in the Urban County for the 2019-2022 cycle and authorize the Assistant County Administrative Officer to execute the required Joint Exercise of Powers Agreement and Cooperative Agreement that allows the County to qualify as an Urban County.

 

DISCUSSION:

Since the first award of an allocation from HUD in FY2013-14, the Urban County has expended more than $5.8 million in CDBG entitlement funds and program income on infrastructure, public facilities, and public services in Del Rey Oaks, Gonzales, Greenfield, Sand City and the unincorporated areas of the County of Monterey.  As part of renewing the Urban County designation, the County of Monterey notified all cities in the County that they had the option of joining the Urban County or remaining under the State CDBG program.  In January 2018, letters were sent to the City Managers of the non-entitlement cities of Carmel-by-the-Sea, Del Rey Oaks, Gonzales, Greenfield, King City, Marina, Pacific Grove, Sand City, and Soledad inviting them to participate in the Urban County.  Four cities: Del Rey Oaks, Gonzales, Greenfield, and Sand City accepted the invitation.

 

The Consolidated Plan is the Urban County’s blueprint for how CDBG funds will be used during the three-year planning cycle.  Because the City of Del Rey Oaks has opted to rejoin the Urban County, the Consolidated Plan needs to be amended to reflect the new geography of the Urban County.  The Urban County prepares an Annual Action Plan that provides more detail on specific activities and projects that will be supported.  The Board of Supervisors considered the 2018-2019 Annual Action Plan on June 19, 2018.

 

OTHER AGENCY INVOLVEMENT:

The City Councils of Del Rey Oaks, Gonzales, Greenfield and Sand City have adopted resolutions expressing their intent to join the Urban County.

 

County Counsel has reviewed the Joint Exercise of Powers Agreement and Cooperative Agreement to Undertake or to Assist in the Undertaking of Essential Activities Pursuant to Title I of the Housing and Community Development Act of 1974, approved as to form.

 

FINANCING:

This action does not change the FY 2018-2019 appropriations, revenues or positions. The HUD grant is an annual agreement.  If the County complies with grant requirements, the County may elect to continue to receive annual entitlement funding, subject to the federal budget process.  Del Rey Oaks participation in the Urban County is anticipated to increase the annual HUD grant by approximately $8,000 annually. 

 

There is no impact to the General Fund if the Board approves the amendment to the Consolidated Plan.

 

BOARD OF SUPERVISORS STRATEGIC INITIATIVES:

Amending the Consolidated Plan will increase the amount of CDBG funding that is available to help local jurisdictions make improvements to public facilities and non-profit agencies to create new housing opportunities for the psychiatrically disabled, provide food security, help children and youth develop the social skills they need to be successful in life and help provide homeless veterans with temporary housing.
