RECOMMENDATION:

It is recommended that the Board of Supervisors:

Approve and authorize the Contracts/Purchasing Officer, or Designee, to sign Amendment Number 10 to the non-standard Maintenance Service Supplement Agreement between the County of Monterey and Zetron, Inc. for maintenance of the ACOM radio console system, to extend the term by one additional year, retroactive to July 1, 2018 through June 30, 2019, and to add $54,358 for the period of July 1, 2018 through June 30, 2019.

SUMMARY:

Monterey County, through its Emergency Communications Department (ECD), contracted with Zetron, Inc. on November 22, 2006 to provide maintenance of ECD’s ACOM radio console system used for public safety radio dispatch operations.  Most County and local agencies to which the County provides dispatch services have transitioned to the Next Generation Radio System (NGEN), which uses a Harris Corporation Symphony radio console.  One agency still relies on the Zetron Inc. ACOM console, however. As a result, the agreement with Zetron, Inc. for ACOM console maintenance needs to be extended until the remaining agency transitions to the NGEN Radio System.

DISCUSSION:

Zetron Inc.’s ACOM console system was scheduled to be decommissioned with the installation of the NGEN/Harris Radio System and the transition to the new system by all agencies to which the County provides dispatch services.  It was originally thought that Zetron’ s contract would only need to be extended through the close of fiscal year 2018, however, American Medical Response (AMR), under contract with the Monterey County Emergency Medical Services Agency (EMSA) for ambulance services, has not been able to transition to the NGEN Radio System due to EMSA’s requirements.  AMR will continue to use the ACOM consoles pending its transition to the NGEN system. Accordingly, it is recommended that the current Zetron contract be extended for an additional year, through Fiscal Year 2018/2019, in order to ensure the functionality of the current ACOM console system and the high level of technical support necessary.

Both the original Maintenance Service Supplement Agreement and Amendment No. 10 to this agreement provide for cancellation for convenience upon ninety (90) days written notice, which will be invoked as soon as AMR has transitioned into the new NGEN System.  The transition date is unknown at this time.  The amount spent on maintenance of the ACOM console will be paid by EMSA.

The Non-Standard terms to the Maintenance Services Supplement with Zetron Inc. remain unchanged.  The Director of ECD recommends that the Board continue its acceptance of the non-standard terms for the short time remaining until the ACOM radio console system is no longer used by the County.

OTHER AGENCY INVOLVEMENT:

County Counsel cannot approve continuation of the non-standard contract terms.  Risk cannot approve non-standard insurance and indemnity provisions. EMSA has been advised of the costs associated with the continued use of the Zetron ACOM dispatch consoles by AMR and has agreed to pay these costs.

FINANCING:

The funds for the amendment of this contract have been included in the Emergency Communications Department annual FY 18/19 budget but will be billed out as a service to EMSA at the close of that fiscal year.

BOARD OF SUPERVISORS STRATEGIC INITIATIVES:

The recommended amendment provides for the continued maintenance of existing public safety radio dispatch systems that contribute to the creation of a safe environment for people to achieve their potential, leading businesses and communities to thrive and grow by reducing violent crimes as well as crime in general.
