RECOMMENDATION:

It is recommended that the Board of Supervisors:

a. Approve and authorize the Director of Health or Assistant Director of Health to execute a Mental Health Services Agreement with Cornell Corrections of California, Inc. dba Southern Peak Regional Treatment Center for the provision of residential and mental health services to Monterey County youth in the amount of $21,264 for Fiscal Year (FY) 2017-18, $131,050 for FY 2018-19, and $131,050 for FY 2019-20 for a total Agreement amount not to exceed $283,364 retroactive to May 1, 2018 through June 30, 2020; and

b. Approve and authorize the Director of Health or Assistant Director of Health to approve up to three (3) future amendments that do not exceed ten percent (10%) ($28,336) of the original Agreement amount and do not significantly alter the scope of services.

 

SUMMARY/DISCUSSION:

Southern Peaks Regional Treatment Center is a residential facility located in Canon City, Colorado that provides residential and community-based treatment services for youth experiencing significant difficulty functioning in their homes, communities and schools.  Southern Peaks Regional Treatment Center is Joint Commission accredited and licensed by the Colorado Department of Human Services as a Residential Child Care Facility from the Division of Behavioral Health for the State of Colorado.   Programs offer specialized treatment options for youth with mental health and behavioral disorders who are victims of sexually exploitation, exhibit sexually abusive behaviors or have educational problems. The residential program is a structured and therapeutic environment for youth in need of an intensive level of residential care.   Treatment interventions include, but are not limited to, individual therapy, group therapy, family therapy, social skills training, psychological and psychiatric support, and medical/psychotropic intervention. 

 

The term of this Agreement is retroactive to May 1, 2018 due to an emergency placement of Monterey County youth in accordance to the youth’s individual treatment plan (IEP).  An emergency placement occurs when the individual is presenting with behaviors that place themselves or others at risk of harm, and can no longer be kept safe in the home and school environments.   The Agreement is presented late to the Board because Southern Peaks Regional Center delayed providing insurance documentation required by the County.

 

This Agreement contains the County’s standard 30-day “no cause” provision (Section IV, B) and an additional defunding provision (Section IV, D), which provides the County the ability to amend or terminate the Agreement in the event of a reduction and/or termination of funding.

 

This work supports the following Monterey County Health Department 2018-2022 Strategic Plan initiative: 3) Ensure access to culturally and linguistically appropriate, customer-friendly, quality health services.  It also supports the following ten essential public health services, specifically: 7) Link people to needed personal health services and assure the provisions of health care when otherwise unavailable.

 

OTHER AGENCY INVOLVEMENT:

County Counsel-Risk Management and Auditor-Controller have reviewed and approved this Agreement as to legal form and fiscal provisions, respectively.

 

FINANCING:

This Agreement is 100% funded by Special Education Local Plan Area (SELPA) funds that pay for children who are placed through the IEP.  The funds for this Agreement ($21,264) are included in the Health Department Behavioral Health (HEA012, Unit 8410) Fiscal Year (FY) 2017-18 Adopted Budget.  The funds for this Agreement for FY 2018-19 ($131,050) and FY 2019-20 ($131,050) will be included in the respective Health Department Behavioral Health (HEA012, Unit 8410) FY 2018-19 and FY 2019-20 Requested Budgets.
