RECOMMENDATION:

It is recommended that the Board of Supervisors:

Approve and authorize the Director of the Information Technology Department to execute Amendment No. 1 to the Agreement with Harris Corporation for Software FX security management services for the Next Generation Radio System, adding $5,042.00 for payment of taxes on taxable software products, for an amended contract amount of $441,042.

 

SUMMARY:

The County, acting through its Information Technology Department (ITD), currently is party to an Agreement with Harris Corporation to provide Software FX security management services for the County’s Next Generation Radio System (NGEN).  ITD recommends adding additional funding to the Agreement in order to pay taxes on specified taxable software products.

 

DISCUSSION:

The County has contracted with Harris Corporation to provide a digital public safety and local government voice and data radio networks systems, the NGEN System, as required by Federal Communications Commission mandate.  In March 2017, the Board approved an agreement with Harris to provide Software FX security management services for the County’s NGEN system. Through this Agreement, Harris Corporation provides technical support, on an as-needed basis, to ensure operational availability of critical public safety communications systems.  It also provides patch management services for updating security related patches to the NGEN system.

 

ITD recommends adding funding to the Agreement to pay taxes on taxable software for software upgrades during the period of May 15, 2018 through May 14, 2019, which was not accounted for in the cost of the original Agreement.  The remaining yearly updates will be completed remotely, which is exempt from sales tax, per the Auditor/Controller. The proposed Amendment will increase the total contract amount only.  All services provided and Agreement terms already approved by the Board in March 2017 will remain the same.  The proposed Amendment does not change the non-standard contract provisions already approved by the Board.

 

 The County’s NGEN system provides mission critical communications to law, fire, and ambulance personnel and to local government, state and federal mutual aid response. Approval of the proposed amendment ensures the continuity and availability of these important emergency communications.

 

OTHER AGENCY INVOLVEMENT:

County Counsel does not approve continuance of non-standard contract provisions.  The Auditor/Controller reviewed tax liabilities attendant to software delivery.

 

FINANCING:

The funds for payment of the costs of this Agreement have been included in the FY 18-19 Approved Budget for the Information Technology, ITD 1930, Unit 8436 Appropriations Unit INF002.

 

BOARD OF SUPERVISORS STRATEGIC INITIATIVES:

The services provided pursuant to this agreement will enable ITD to provide the County with a 24-hour technical assistance as needed on critical County radio transmission equipment.
