RECOMMENDATION:
It is recommended that the Monterey County Water Resources Agency Board of Supervisors authorize the Monterey County Water Resources Agency General Manager to execute an easement agreement with Jeff Carlton to set the exact location of an easement that was previously granted in a Grant Deed recorded on March 2, 1970.
SUMMARY/DISCUSSION:
Jeff Carlton owns property on the south shore of Nacimiento Reservoir that is landlocked by Agency property. This property was previously owned by Madeline Trigueiro. Agency staff recovered archived files that directly address the Carlton Property, previously known as the Trigueiro property. Based on this document research, it was determined that an easement to the property was granted in 1970, but specific detail as to the easement's location was not provided. The Agency (then the Flood Control District) was supposed to subsequently record the easement's location, but this was never done.
On March 9, 2018, Jeff Carlton came before the Personnel and Administration Committee requesting an exact easement location to his landlocked property, and this Committee recommended this action. On September 17, 2018, the Monterey County Water Resources Agency Board of Directors recommended this action as well.
This action will allow the General Manager to sign the easement agreement, which delineates the exact location of the easement.
OTHER AGENCY INVOLVEMENT:
County Counsel reviewed the easement agreement as to form.

There is no financial impact.
