Report

RECOMMENDATION:

It is recommended that the Board of Supervisors:

a.                     Approve and Authorize the Sheriff or Undersheriff to sign a two (2) year Memorandum of Understanding (MOU) with the Carmel Unified School District, for provision of a School Resource Officer funded via a Tobacco Law Enforcement Grant for a not to exceed amount of $248,878 in FY 2018-19 and $236,508 for FY 2019-20 for a total, not to exceed amount of $485,386 over two (2) years;

b.                     Add one (1.0) FTE Deputy Sheriff-Enforcement to the Sheriff’s Office Budget Unit 001-2300-SHE001-8242, effective August 4, 2018;

c.                     Authorize the County Administrative Office to incorporate the position change into the Sheriff’s Office FY 2018-19 Adopted Budget; and

d.                     Authorize the Auditor-Controller to increase appropriations and revenues for FY 2018-19 in Sheriff’s Office Budget Unit 001-2300-SHE001-8242-6111/5570 by $248,878, respectively for Year 1 of this MOU. 

 

SUMMARY:

The Budget Committee has approved to submit this report to the full Board on July 25, 2018.  The Sheriff’s Office (the Office) is requesting retroactively to add the requested position effective August 4, 2018 to be in compliance with the grant requirements as a Deputy Sheriff was assigned to the position on August 4, 2018.  The Office was not able to submit this report earlier because of timing issues, such as when the MOU was signed and dates of Budget Committee and Board meetings.  Carmel Unified School District (CUSD) approached the Monterey County Sheriff’s Office (MCSO) about securing a School Resource Officer for the FY 2018-19 School year, and CUSD and MCSO were in negotiations on this subject when Tobacco Law Enforcement funding was made available to school districts for School Resource Officers (SRO). Your Board’s direction to all departments was to seek out additional external funding sources, so with MCSO’s assistance, CUSD applied for, and was granted two years of funding for the SRO from the California Office of the Attorney General’s Tobacco Law Enforcement program.

 

The purpose of this Memorandum of Understanding (MOU) is to delineate responsibilities and purview between CUSD and MSCO, and to provide a method for CUSD to pay MCSO for supplying a school resource officer. The MOU clearly indicates that this is a grant funded position, and that continuation of the position is based on continued grant funding. CUSD will complete all grant reports, and submit all reimbursements to the Attorney General, since they are the grantee in this situation. MCSO will bill CUSD quarterly, to allow them to promptly receive funding under the grant.

 

 The educational focus of this grant is on vaping, and in specific, the JUUL® nicotine delivery system. This product delivers a particularly concentrated dose of nicotine, and is considered so harmful that it has been banned in Europe.  CUSD has also added a strong focus on parental education, focusing on parents of incoming freshmen. They will be utilizing the school resource officer to make presentations to their high school and middle school health classes, provide educational meetings for instructors, and will ask the school resource officer to assist in supervising problem areas on campuses. They plan to update tobacco signage on all campuses, and are installing smoke detectors in critical areas.

 

A copy of the MOU is on file with the Clerk of the Board. This MOU has already been approved by the CUSD Board.

 

OTHER AGENCY INVOLVEMENT:

County Counsel has approved the agreement as to legal form, the Auditor-Controller has reviewed as to fiscal provisions and Human Resource Department concurs with the recommendation. CUSD collaborated with MCSO to achieve this grant.

 

FINANCING:

The grant is a reimbursement grant and the amount of the MOU is a maximum amount. The MOU amount for FY 2018-19 is $248,878 and the FY 2019-20 MOU amount is $236,508, for a not to exceed MOU amount over two years of $485,386.
