RECOMMENDATION
It is recommended that the Board of Supervisors:
a. Consider the Fort Ord Reuse Authority (FORA) Transition Plan Draft Resolution;
b. Consider making recommendations to FORA; and
c. Provide direction to staff.

SUMMARY/DISCUSSION
Pursuant to Government Code section 67700, the Fort Ord Reuse Authority (FORA) is to be dissolved as of June 30, 2020, and the FORA Board is required to "approve and submit a transition plan to the Monterey County Local Agency Formation Commission" on or before December 30, 2018. The agenda for the FORA Board's September 28, 2018 meeting lists "Transition Planning Process Update" (Agenda Item No. 8e), which includes consideration of a Draft Transition Plan Resolution. See Attachment 1.

On September 25, 2018, the Board of Supervisors received a report from County staff and provided direction to staff regarding FORA's Transition Plan and the transition planning process. See Attachment 2. At this meeting, the Board directed staff and counsel to return on October 2, 2018 to present an analysis of FORA's Draft Transition Plan Resolution. The Board also voted unanimously to request that the FORA Board delay any vote on the draft resolution until FORA's regularly scheduled meeting in October, and further directed County Counsel to submit a letter to the FORA Board of Directors to express some of the County's legal questions and concerns. See Attachment 3.

County staff and County Counsel are analyzing the draft resolution and will present this analysis to the Board on October 2, 2018.

OTHER AGENCY INVOLVEMENT
