RECOMMENDATION:

It is recommended that the Board of Supervisors:

a.                     Approve and Authorize the Contracts/Purchasing Officer or Contracts/Purchasing Supervisor to sign a new two (2) year agreement containing non-standard language with Covanta Holding Corp. DBA Covanta Energy LLC for incineration of narcotics, knives and other small weapons in the amount of $20,000.00; and

 

b.                     Authorize the Contracts/Purchasing Officer or Contracts/Purchasing Supervisor to sign up to three (3) future amendments to the agreement where the amendments do not significantly change the scope of work, and where the amendments do not increase the contract value more than ten percent (10%) or $2,000.00, for a maximum, not to exceed amount of $22,000.00.

 

SUMMARY:

The Monterey County Sheriff’s Office (MCSO) collects and removes narcotics and small weapons, such as shanks, knives, throwing stars and nun-chucks in the course of conducting investigations. These items are not returned to the public and are destroyed.

 

A destruction facility must carry a special level of licensure to accept and incinerate narcotics and small weapons, and our local landfill does not perform this function. MCSO has a contract with Stericycle for medical waste, but Stericycle does not accept narcotics for destruction.

 

This contract is for a facility in Crows Landing, CA that is used by the Highway Patrol and most local law enforcement agencies. Narcotics must be transported by MCSO deputies to the facility, for safekeeping purposes and to meet narcotics destruction protocols. Deputies are provided with a certificate of destruction prior to leaving the facility. This is the closest facility of its kind, hence the reason we are asking for a contract to use the facility.

 

A copy of this Agreement is on file with the Clerk of the Board.

 

OTHER AGENCY INVOLVEMENT:

County Counsel has reviewed as to legal form, and the Auditor/Controller has reviewed for fiscal provisions. Risk Management is unable to approve as the contract contains non-standard mutual indemnification language. The Sheriff requests approval of the contract because there is no other facility within a three (3) hour drive that offers this service. 

 

FINANCING:

The costs of this contract are estimated to be less than $4,000.00 per year, and this amount is included in the FY 2018-19 fiscal year budget. There will be no increase in the General Fund Contribution arising out of this board action.
