RECOMMENDATION:

It is recommended that the Board of Supervisors’ Budget Committee:

a.  Support to approve and authorize the Sheriff or Undersheriff to sign a two (2) year Memorandum of Understanding (MOU) with the North Monterey County Unified School District, for provision of up to three (3) School Resource Officers funded via a Tobacco Law Enforcement Grant for a not to exceed amount of $651,951 per year in FY 2018-19 and FY 2019-20 for a total, not to exceed amount of $1,303,902 over two (2) years retroactively effective July 18, 2018;

b.  Support to add one (1) FTE Deputy Sheriff-Enforcement to the Sheriff’s Office Budget Unit 001-2300-SHE001-8242 retroactively effective July 18, 2018;

c.  Support to authorize the County Administrative Office to incorporate the position change into the Sheriff’s Office FY 2018-19 Adopted Budget; and

SUMMARY:

When Tobacco Law Enforcement funding was made available to school districts for School Resource Officers (SRO), the North Monterey County Unified School District (NMCUSD) and the Monterey County Sheriff’s Office (MCSO) were in negotiations on renewing an agreement to continue to have a School Resource Officer for the FY 2018-19 School year.  With MCSO’s assistance, NMCUSD applied for, and was granted two years of funding for three SRO(s) from the California Office of the Attorney General’s Tobacco Law Enforcement program.

 

Even though the grant and the MOU amount is for three (3) full time SROs, MCSO is not able to assign all three SROs but only one SRO at this time due to staffing shortage for the essential duties and responsibilities of MCSO.  Once MCSO reaches to the appropriate staffing level and when both parties agree to assign additional SRO(s), MCSO will come back to your Committee to request to add more positions and to amend the Sheriff’s Office budget.  In the FY 2017-18, an SRO position was funded by the District and by the General Fund equally.  However, the position was included in the FY 2018-19 Sheriff’s budget to be fully funded by the General Fund only as the two parties were not in an agreement on how to fund the position at the time of the budget.    

 

The purpose of this Memorandum of Understanding (MOU) is to delineate responsibilities and purview between NMCUSD and MSCO, and to provide a method for NMCUSD to pay MCSO for supplying a school resource officer. The MOU clearly indicates that this is a grant funded position, and that continuation of the position is based on continued grant funding. NMCUSD will complete all grant reports, and submit all reimbursements to the Attorney General, since they are the grantee in this situation. MCSO will bill NMCUSD monthly, to allow them to promptly receive funding under the grant.

 

The educational focus of this grant is on vaping, and in specific, the JUUL® nicotine delivery system. This product delivers a particularly concentrated dose of nicotine, and is considered so harmful that it has been banned in Europe.  NMCUSD has also added a strong focus on parental education, focusing on parents of incoming freshmen. They will be utilizing the school resource officer to make presentations to their high school and middle school health classes, provide educational meetings for instructors, and will ask the school resource officer to assist in supervising problem areas on campuses. They plan to update tobacco signage on all campuses, and are installing smoke detectors in critical areas.

 

A copy of the MOU is on file with the Clerk of the Board. This MOU has already been approved by the NMCUSD Board.

 

OTHER AGENCY INVOLVEMENT:

County Counsel has approved the agreement as to legal form, the Auditor-Controller has reviewed as to fiscal provisions and Human Resource Department concurs with the recommendation. NMCUSD collaborated with MCSO to achieve this grant.

 

FINANCING:

There is no General Fund Contribution as a result of this recommendation.  The grant is a reimbursement grant and the grant amount is $651,951 per year in FY 2018-19 and FY 2019-20 for a total, not to exceed amount of $1,303,902 over two (2) years.  For FY 2018-19, the MCSO is requesting to increase $217,317 each in expenditure and revenue accounts as the MCSO is expecting to assign one SRO.
