RECOMMENDATION:

It is recommended that the Board of Supervisors:

a.                     Approve Standard Agreement with San Miguel Garbage Co., Inc. to provide solid waste containers and solid waste and recycling collection services at the Lake Nacimiento Resort in a total amount not to exceed $379,608 for a term of five (5) years from February 26, 2019 to February 25, 2024; and

b.                     Authorize the Contracts/Purchasing Officer or Contracts/Purchasing Supervisor to execute the Standard Agreement and up to three (3) amendments to the Agreement where the amendments do not significantly alter the scope of work, and where the amendments do not increase the Agreement amount more than ten percent (10%).

 

SUMMARY/DISCUSSION:

The County of Monterey Resource Management Agency (RMA) (hereinafter, “County”) has identified a need for solid waste and recycling collection services at the Lake Nacimiento Resort (hereinafter, “Resort”).  The County currently self-performs the solid waste/refuse removal with County equipment and staff.  County staff time would be better utilized performing maintenance activities.  Additionally, to continue operations of the solid waste and recycling collection function, the County would need to purchase new equipment.  Without provision of these required refuse services, the County cannot continue to operate the Resort.

 

Staff researched potential contractors to provide the required solid waste and recycling collection services at the Resort.  It was determined that the San Miguel Garbage Co., Inc. (SMGC) is the only provider serving the geographical area at Lake Nacimiento.  There is no alternative service for refuse removal.  Additionally, these services may only be provided by the operator of the facility (County) or SMGC as the only contractor serving the geographical region.

 

SMGC is a solid waste/refuse removal and recycling contractor that has provided services in San Luis Obispo County for over fifty (50) years.  It is a family owned and operated business offering a variety of state-of-the-art services including automated waste and recycling collection, green waste recycling programs, transfer and materials recovery, and storage box rentals. 

 

A Standard Agreement (SA) with SMGC will provide for forty (40) three-yard (3 yd.) solid waste containers throughout the Resort (see Attachment B Location Map) and allow for solid waste collection and recycling services for a total amount not to exceed $379,608, for a term of five (5) years from February 26, 2019 to February 25, 2024.  During the winter months and on a weekly basis, SMGC shall provide minimal collection services at the Resort.  During the summer months, starting the week before Memorial Day weekend and ending the week after Labor Day, SMGC shall provide service at a minimum of three (3) days per week.  Currently, SMGC provides the County with eleven (11) recycling containers and collection services at no cost on an every other week service level or less if not needed.  SMGC shall keep this no cost service level in place and only charge for additional collections.

 

OTHER AGENCY INVOLVEMENT:

The Office of the County Counsel-Risk Management recommended $5 million in coverage for Pollution Liability, however RMA believes $1 million in coverage is sufficient based on isolated site and low risk.  The Offices of the County Counsel-Risk Management and Auditor-Controller have reviewed and approved this SA as to form and legality and fiscal provisions, respectively. 

 

FINANCING:

The total not to exceed amount of the Standard Agreement between the County and San Miguel Garbage Co., Inc. is $379,608:

 

February 26, 2019 - February 25, 2020:                       $72,219.20

February 26, 2020 - February 25, 2021:                       $74,024.68

February 26, 2021 - February 25, 2022:                       $75,875.30

February 26, 2022 - February 25, 2023:                       $77,772.18

February 26, 2023 - February 25, 2024:                       $79,716.48

 

Sufficient appropriations are available in the RMA Lake Operations Budget (Fund 452, Department 3000, Unit 8477, Appropriations Unit RMA102) to finance the SA for Fiscal Year (FY) 2018-19 and will be included in the Recommended Budget for FY 2019-20 and future FYs. 

 

BOARD OF SUPERVISORS STRATEGIC INITIATIVES:

The SA with SMGC will provide solid waste containers and solid waste and recycling collection services at the Resort.  Removal of refuse generated from camping and recreational activities is a required service.  The recommended action supports the Board of Supervisors’ Strategic Initiatives as indicated below:
