RECOMMENDATION:

It is recommended that the Budget Committee:

a. Support approving Amendment No. 3 to Agreement No. A-12598 with Lionakis to continue to provide additional architectural services for schematic design through construction for completion of the Jail Housing Addition Project, Project No. 8819, under Request for Qualifications No. 10401, to increase the not to exceed amount by $278,007 for a total amount not to exceed $4,916,058, with no term extension to the term of November 18, 2013 to December 31, 2019; and

b. Support authorizing the Contracts/Purchasing Officer or Contracts/Purchasing Supervisor to execute Amendment No. 3 to Agreement No. A-12598 and any future amendments that do not significantly alter the scope of work or change the approved Agreement amount.

 

SUMMARY/DISCUSSION:

Lionakis was selected for their professional qualifications and expertise in specialized detention projects necessary to provide architectural services for schematic design through construction services (hereinafter, “services”) for the Jail Housing Addition Project, Project No. 8819 (hereinafter, “Project”) through a competitive selection process in accordance with County policies and State laws under Request for Qualifications (RFQ) No. 10401.

On November 5, 2013, the Board of Supervisors approved Agreement No. A-12598 with Lionakis to provide said services in an amount not to exceed $2,608,643 with a term from November 18, 2013 through June 30, 2018.  On March 25, 2014, Amendment No. 1 to the Agreement increased the amount by $2,029,408, to provide architectural programming for an additional 288 medium-security beds for a total of 576 medium-security beds, for a total amount not to exceed $4,638,051 and extended the term for six (6) additional months through December 31, 2018.  On December 20, 2018, Amendment No. 2 to the Agreement updated the Indemnification for Design Professional Services Claims provision of the Agreement and further extended the term for one (1) additional year through December 31, 2019.

 

Amendment No. 3 increases the total not to exceed amount of $4,638,051 by $278,007 for a total amount not to exceed $4,916,058 with no extension to the term of the Agreement.  The additional not to exceed funding is necessary for Lionakis to design new electrical switchgear, provide additional visitation program space for the Project, and to complete other necessary revisions to the construction documents.

Attachment G provides a summary of the Agreement to date.  Attachment H provides a summary of the Agreement annual expenditures and balance.

OTHER AGENCY INVOLVEMENT:

The Office of the County Counsel-Risk Management and Auditor-Controller’s Office have reviewed and approved Amendment No. 3 as to form and legality, and fiscal provisions, respectively. 

FINANCING:

The proposed increase to the Agreement is within budget.  Costs associated with Amendment No. 3 to the Agreement with Lionakis will change the total estimated Project cost, including engineering, environmental, and construction, to the amount of $85,990,435.  The total not to exceed amount of Lionakis’ Agreement for the Project is $4,916,058.  Of this amount, $492,994 is the estimated cost for Fiscal Year (FY) 2018-19.  The remaining amount of this Agreement is scheduled to be spent in FY 2019-20.    Sufficient appropriations are available for this project in the FY 2018-19 Adopted Budget for Fund 404, Unit 8174, Appropriations Unit RMA015. 

BOARD OF SUPERVISORS STRATEGIC INITIATIVES:

The Agreement with Lionakis, as amended under Amendment No. 3, continues to recognize the exigent need for the services to construct a permanent solution for the Project.  The Project is needed to provide a larger facility as the high occupancy count makes it critical, and additionally to assist the County with the State-mandated milestones.  The recommended action supports the BOS’ Strategic Initiatives as indicated below:
