RECOMMENDATION:

It is recommended that the Board of Supervisors:

a. Approve and authorize the Chair of the Board of Supervisors, on behalf of the Board in its role as the Chief Elected Official for the Monterey County local workforce development area, to sign the Application for Subsequent Local Area Designation and Local Board Recertification, Program Years 2019-21, as required by the Workforce Innovation and Opportunity Act; and

b. Approve and authorize submittal of the Application to the California Workforce Development Board

 

SUMMARY/DISCUSSION:

In accordance with Section 106 and 107 of the Workforce Innovation and Opportunity Act (WIOA), the Monterey County WDB is applying, as an Existing Local Area, for Subsequent Local Area Designation and Local Board Recertification. Continued receipt of WIOA funding is conditioned upon continuing designation as a local workforce area and continuing certification as a local Area workforce development board.

 

The State of California Employment Development Department (EDD) issued a final directive on May 16, 2019 establishing the policies and procedures governing requests for local area subsequent designation and local board recertification under WIOA. The directive contains state-imposed requirements, as well as federal requirements. If the Monterey County Workforce Development Board’s request for Subsequent Local Area Designation and Local Board Recertification is approved by the California Workforce Development Board, its designation and recertification will be effective July 1, 2019 through June 30, 2021.

 

After the initial designation period of a Local Area, WIOA Section 106 requires a subsequent designation process.  It requires the Governor to approve a request for subsequent designation as a local workforce area if the area performed successfully, sustained fiscal integrity, and engaged in the regional planning process.

 

WIOA Section 107 establishes criteria for the recertification of local boards. Specifically, it requires the Governor to certify one local workforce board for each local workforce area in the state once every two years. In order to be recertified, a local board must meet the WIOA membership requirements, must have met or exceeded performance accountability measures, and must have achieved sustained fiscal integrity.

 

The Monterey County Workforce Development Board’s application for subsequent local workforce area designation and local board recertification is submitted for the Board of Supervisors’ approval, in its role as the Chief Elected Official of the Monterey County local workforce area.  The application demonstrates that WIOA requirements are met and establishes the basis for continued receipt of WIOA funding.

 

Applications are due to the California Workforce Development Board on June 14, 2019.  It is recommended that the Board of Supervisors authorize the Chair to sign the application, on its behalf, and authorize its submittal. 

 

As it will not be possible to obtain the approval and signature of the Chief Elected Official on the Monterey County Workforce Board’s application by the June 14, 2019 deadline, the Monterey County WDB will be allowed to submit an unsigned copy by the deadline, accompanied by an explanation for the absent signature(s) and a date by which the signed original will be sent.  Local areas will not receive full subsequent designation status until a signed application is received by the California Workforce Development Board

 

OTHER AGENCY INVOLVEMENT:

County Counsel has reviewed the proposed Application for Subsequent Local Area Designation and Local Board Recertification as to form.

 

FINANCING:

There is no impact on the Monterey County General Fund as WIOA activities are fully financed by federal funds.

 

BOARD OF SUPERVISORS STRATEGIC INITIATIVES:

Approval of the Application for Subsequent Local Area Designation and Local Board Certification, as required by WIOA, will promote the continued delivery of job training and placement services, thereby enhancing economic development in Monterey County.

                     Administration - Promote an organization that practices efficient and effective resource management and is recognized for responsiveness, strong customer orientation, accountability and transparency.
