RECOMMENDATION:
It is recommended that the Board of Supervisors, acting as the Board of Directors of the East Garrison Community Services District, accept from the County of Monterey, the completed East Garrison Phase Two and Phase Three on-site drainage improvements into the East Garrison Community Services District maintenance system.
SUMMARY:
The recommended action will allow the East Garrison Community Services District (EGCSD) to accept the completed East Garrison Phase Two and Three on-site drainage improvements into the EGCSD maintenance system in accordance with the Final Subdivision Maps for East Garrison Phase Two and Phase Three, Urban Services Agreement as amended, and approved Operation and Maintenance Plan.
DISCUSSION:
On March 1, 2016, the County of Monterey (County) accepted the completed East Garrison Phase Two infrastructure improvements, and on December 11, 2018, accepted the completed East Garrison Phase Three infrastructure improvements, both of which included on-site drainage improvements to be operated and maintained by EGCSD. Acceptance of these improvements is done by dedication on the Final Subdivision Maps for East Garrison Phase Two and Phase Three, rather than by transfer of grant deed.
Since March 26, 2013, drainage improvements have been maintained by the EGCSD through the Temporary Maintenance Agreement with the Developer which provides for the continued proper, efficient, and cost-effective maintenance of the East Garrison Project, in a manner that promotes the continued development of the Project.
