Title: a. RECOMMENDATION:

It is recommended that the Board of Supervisors:

a.                     Approve and Authorize the Contracts/Purchasing Officer or Contracts/Purchasing Supervisor to sign Amendment #2, with Aramark Services Inc Doing Business As Aramark Correctional Services, in the amount not to exceed $4,418,318.00, and extend the term of the agreement one (1) additional year and one (1) month, retroactive to June 1, 2019, for an amended term of October 1, 2016 to June 30, 2020; and

b.                     Ratify and Authorize the Auditor-Controller to issue a payment in the amount of $246,513.53, for the critical services provided prior to the start of the new amendment; and

SUMMARY/DISCUSSION:

The Monterey County Sheriff’s Office (MCSO) request approval of Amendment #2. The MCSO operates an Adult Detention facility in Salinas. The average daily population of this facility is anywhere from 950 inmates to as high as 1100 inmates per day. The County is required to provide all inmates with three meals a day, at county expense, per Title 15 regulations. In addition to the meal service system, there is a commissary order system operating in the jail where inmates can purchase additional foodstuffs, toiletries and stationery using funds placed into their personal account, maintained by the commissary software system. Any funds not expended during the course of an inmate’s stay are refunded to them upon release. 

 

The food service contract is structured on a per meal basis and provides one (1) hot meal and two (2) cold meals per day per inmate. The cost of this contract will fluctuate, based on inmate population and based on the percentage change in the Consumer Price Index, All Urban Consumers, U.S. City Average (“CPI-U”). Monthly vendor invoices are received and reconciled to the monthly inmate count reports prepared by Jail site staff, and any discrepancies are discussed and resolved.

 

This agreement is late due to not having a contracts person on staff and the failed negotiation of an agreed upon new CPI-U. The contract allows for the negotiation of a mutually agreed upon CPI-U, however, in the event that an agreement cannot be made the CPI-U will be based on the yearly percentage change in the Consumer Price Index, All Urban consumers, U.S. City Average (CPI-U), published by the U.S Department of Labor. This change will be effective on October 1st of the calendar year.

 

OTHER AGENCY INVOLVEMENT:

Due to the critical nature of the services being provided, Contracts Purchasing and the Auditor-Controller authorized payment prior to the new amendment being signed. County Counsel has approved the agreement as to legal form.

 

 

FINANCING:

The $1,146,321.00 includes the $246,513.53 payment made by the Auditor-Controller as well as the new extended term. The cost of this contract was included in the FY 2019-20 proposed budget. There will be no increase in General Fund Contribution resulting from this Board action.
