RECOMMENDATION:
Approve and authorize the Contracts/Purchasing Officer or Contracts/Purchasing Supervisor to execute the First Amendment with New Cingular Wireless PCS, LLC for the purpose to modify and/or replace wireless equipment located at 1025 Monterey Highway 68, Salinas, California. (aka WeatherTech Raceway Laguna Seca) in order to complete equipment upgrades and maintain compliance with current and future federal, state or local mandated applications, including but not limited to emergency 911 communications services as outlined within Exhibit B-2 of the First Amendment.
SUMMARY/DISCUSSION:
The County of Monterey entered into a 20-year Site Lease Agreement with New Cingular Wireless PCS, LLC (New Cingular) on June 7, 2006 to operate and maintain a wireless communication site located at 1025 Monterey Highway 68, Salinas, Californa. New Cingular’s equipment and antennae are located on the County’s monopole communications tower along with other appurtenant and incidental equipment in the designated area(s) identified within Exhibit B of the Site Lease Agreement. Approval of the proposed First Amendment to the Site Lease Agreement will allow New Cingular to complete equipment upgrades and maintain compliance with current and future federal, state or local mandated applications, including but not limited to emergency 911 communications services as outlined within Exhibit B-2 of the First Amendment. In addition, the current annual lease fee of $25,663 will be increased by $5,700 as per this First Amendment to equal $31,363, subject to a 3% annual adjustment as provided in the Site Lease Agreement.
OTHER AGENCY INVOLVEMENT:
The Resource Management Agency negotiated the proposed First Amendment and assisted with the development of this report. The Office of the County Counsel-Risk Management has reviewed the proposed First Amendment as to form and legality.
FINANCING:
There is no anticipated fiscal impact to the General Fund resulting from approval of the proposed First Amendment. The anticipated $31,363 lease fee received from New Cingular will continue to be deposited as revenue in 001-3000-8176-RMA006.
