Report

RECOMMENDATION:

It is recommended that the Board of Supervisors:

a. Approve and authorize the Director of Health or Assistant Director of Health to sign an Agreement with UpToDate, Inc. (“UpToDate”) to provide an UpToDate Anywhere Electronic Clinic Resources Subscription for the period of November 1, 2019 to October 31, 2022 and a total contract amount not to exceed $57,141; and

b. Accept the non-standard Agreement and risk terms regarding indemnification and insurance provisions in the Agreement; and

c. Authorize the Director of Health or Assistant Director of Health to approve up to three (3) future amendments that do not significantly change the scope of services.

 

SUMMARY/DISCUSSION:

The Health Department Clinic Services Bureau (Clinic Services) operates nine community clinic sites designated as Federally Qualified Health Center Look-Alikes (FQHC-LA), which provide preventative, primary, and specialty medical care services. 

 

UpToDate, Inc. (“UpToDate”) is the leading web-based clinical research tool utilized in clinic to obtain answers to clinical questions, including the latest evidence, and provides for specific, practical recommendations for diagnosis and treatment.  Included in the subscription, at no additional cost, is the functionality of UpToDate Anywhere.  This enhancement will allow for physician and mid-level remote access to UpToDate from any internet-enabled device including desktop computers, laptops, and mobile devices.

 

Clinic Services currently has an agreement with UpToDate that will expire October 31, 2019.  Clinic Services is requesting insurance modifications to the additional insured and primary, non-contributory provisions for automobile and commercial general liability since the subscription services are entirely web-based and do not involve any on-site training or travel. Vendor has non-California Worker’s Compensation insurance. Approval of recommendation will provide Clinic Services physicians and mid-levels un-interrupted access to this valuable resource tool by conveniently providing current medical information and resources at the point of patient care. 

 

This work supports the Monterey County Health Department 2018-2022 Strategic Plan Initiatives(s): 1. Enhance community health and safety through prevention. It also supports the following of the ten essential public health services, specifically: 3. Inform, educate and empower people about health issues; and 10) research for new insights and innovative solutions to health problems.

 

OTHER AGENCY INVOLVEMENT:

County Counsel-Risk Management, the Auditor-Controller and Contracts/Purchasing have reviewed the Agreement and concur with the recommendation.

 

FINANCING:

Sufficient appropriations are available in FY 2019-20 Adopted Budget of Clinic Services Bureau, Health Department (4000-HEA007).  The Agreement is funded by revenues from Medi-Cal and Medicare.  There is no financial impact to the General Fund resulting from approval of this Agreement.
