RECOMMENDATION:

It is recommended that the Board of Supervisors approve and authorize the County Administrative Officer to send a notice of non-renewal, effective December 31, 2019, of the Permit for Law Enforcement Firearm Range at Laguna Seca Recreation Area, authorized by Resolution 77-86.

 

SUMMARY/DISCUSSION:

Resolution 77-86 granted a permit authorizing the Monterey County Peace Officers Association to “establish, and thereafter operate and maintain, the Law Enforcement Firearm Range and building on such portion of said Laguna Seca Recreation Area as may be designated by the County’s Director of Parks.” The permit expired on December 31, 1980 and has been automatically renewed on an annual basis per the resolution. The resolution provides that either party may terminate the permit by giving at least thirty (30) days’ notice of non-renewal before the annual termination.

 

The County Administrative Office has held meetings with the Peace Officers Association and the Sheriff’s Office to discuss future management and range usage. All parties agree, and a County of Monterey Standard Agreement will be presented for Board of Supervisors’ approval prior to the end of the 2019 calendar year for the Peace Officers Association to continue operation and maintenance of the Law Enforcement Firearm Range. Additionally, the new agreement will allow for range use by the Sheriff’s Office, Probation Department and the District Attorney’s Office. Accordingly, the permit authorized by Resolution 77-86 needs to be terminated by providing the required notice. This action will authorize the County Administrative Officer to send the notice.
