RECOMMENDATION:

It is recommended that the Board of Supervisors:

a.  Approve a maintenance agreement with the State of California Department of Parks and Recreation Division of Boating and Waterways for ongoing operation and maintenance of three (3) floating restroom units at the Lake Nacimiento reservoir, with a retroactive effective date of February 24, 2015 through February 23, 2025; 

b.  Approve a maintenance agreement with the State of California Department of Parks and Recreation Division of Boating and Waterways for ongoing operation and maintenance of two (2) floating restroom units at the Lake San Antonio reservoir, with a retroactive effective date of April 27, 2015 through April 26, 2025; 

c.  Authorize the Contracts/Purchasing Officer or Contracts/Purchasing Manager to sign agreement C8956501 with the State of California Division of Boating and Waterways with a retroactive effective date of February 24, 2015 through February 23, 2025, for ongoing operation and maintenance of three (3) floating restroom units at Lake Nacimiento reservoir; and

d.  Authorize the Contracts/Purchasing Officer or Contracts/Purchasing Manager to sign agreement C8956502 with the State of California Division of Boating and Waterways with a retroactive effective date of April 27, 2015 through April 26, 2025, for ongoing operation and maintenance of two (2) floating restroom units at Lake San Antonio reservoir.

 

 

SUMMARY/DISCUSSION

The Parks Department’s was integrated into the Resource Management Agency (RMA) in 2016.  Prior to that, in 2015, the State of California Department of Parks and Recreation Division of Boating and Waterways (DBW) purchased five (5) new floating restroom units for the Lake Nacimiento and Lake San Antonio reservoirs and granted them to the County.  These new units were to replace existing floating restrooms that had become inoperable.  Floating restrooms are important element of maintaining the reservoir water quality.  Both reservoirs provide boating access to areas far from any restroom facilities. The fluctuation of reservoir levels and difficult terrain along the shoreline prevent the use of portable toilets in remote areas and make the use of floating restrooms in remote areas an important health and safety alternative.

 

This grant was approved by the Board pursuant to County procedures.  However, RMA recently discovered that the associated grant agreements for maintenance of these units by the County were never finalized.  These agreements commit the County to ten (10) years of operation and maintenance, starting from the date of acceptance (February 24, 2015 for the units placed at Lake Nacimiento; April 27, 2015 for the units placed at Lake San Antonio).  In May 2019, DBW provided RMA with the agreements (Attachments A and B) and requested that the agreements be signed and returned.  Therefore, RMA is now requesting that the Board ratify the DBW maintenance agreements associated with the five (5) floating restroom units.

 

OTHER AGENCY INVOLVEMENT:

The Office of the County Counsel reviewed and approved the maintenance agreements as to form and legality.

 

FINANCING:

County Parks staff has maintained the floating restrooms since receiving the units in 2015 at a total annual cost of $1,300.  The FY 2019-20 Adopted Budget, Fund 452, Appropriation Unit RMA102, includes sufficient funds to cover the $780 in costs associated with maintenance and operation of the units at Lake Nacimiento.  The FY 2019-20 Adopted Park Operations Budget, Fund 001, Appropriation Unit RMA104, does not include additional staffing or operating costs at Lake San Antonio.  However, the $520 for maintenance costs for the units is included in the FY 2019-20 Lake San Antonio Operations Plan budget augmentation request of December 10, 2019.  Ongoing annual costs will be included in future budgets.

 

BOARD OF SUPERVISORS STRATEGIC INITIATIVES:

This recommendation is consistent with the Board of Supervisors’ Administration, Health & Human Services, and Public Safety Strategic Initiatives by providing for the efficient and cost-effective management of County Parks.  Floating restrooms prevent contamination of the reservoirs, maintaining environmental and public health.
