b. Approve the non-standard insurance language regarding professional liability coverage as recommended by the Director of Health.

RECOMMENDATION:

It is recommended that the Board of Supervisors:

a. Approve and authorize the Director of Health or Assistant Director of Health to execute Amendment No. 2 to Standard Agreement A-13951 with Matthew R. Mock, Ph.D., Consultant for the provision of training and consultation services to extend the term for one (1) year for a revised term of June 1, 2018 to June 30, 2021, to add $52,000, and to incorporate the Business Associate Agreement, for a revised total Agreement amount not to exceed $81,000; and

b. Approve the non-standard insurance language regarding professional liability coverage as recommended by the Director of Health.

 

SUMMARY/DISCUSSION:

Matthew R. Mock, Ph.D. (“Dr. Mock”), a professor of psychology and award winning national and international trainer, has a private practice, clinical and consulting practice.  Through his teaching activities, he is helping develop the “next generation” of diverse mental health providers.  Dr. Mock was the Director of the Family, Youth, Children’s and Multicultural Services, City of Berkeley Mental Health Division for twenty (20) years. Dr. Mock went on to serve as the Director for the Center of Multicultural Development with the California Institute for Mental Health.  Dr. Mock has consulted, trained or provided services in over forty-five (45) of California’s fifty-eight (58) counties.

 

Approval of this recommended Amendment No. 2 will enable the Behavioral Health Bureau to continue to receive Cultural Competence trainings and consultations from Dr. Mock.  Dr. Mock’s work includes the State of California’s focus of “Cultural Competence and Cultural Humility” as well as “Culturally and Linguistically Appropriate Services (CLAS) Standards (Federal Office of Minority Health).”  The course work provides a shared foundation for enhancing cultural diversity, equity, inclusion and humility.  This Amendment will incorporate the Business Associate Agreement’s “Standards for Privacy of Individually Identifiable Health Information” required for consultation services under the Agreement. 

In the event of a malpractice suit, the County would only be covered for damages and not defense related attorneys’ fees and costs, arising out of a professional incident covered under the Professional Liability policy. The Health Department recommends accepting this endorsement because Dr. Mock will be providing only consultation services to County staff to help improve treatment efficiency and effectiveness.  Dr. Mock will not be directing County staff regarding any specific patient treatments, nor will Dr. Mock be informed of any identifying client information.

 

Execution of this Amendment No. 2 by the Director of Health or Assistant Director of Health requires Board approval.  The funds added by Amendment No. 2 exceed the authority in the Board’s order approving the original Agreement, which also authorized execution of up to three (3) amendments not to exceed ten percent (10%) or $2,200 of the amount of the original Agreement.

 

This work supports the Monterey County Health Department 2018-2022 strategic initiatives:  3. Ensure access to culturally and linguistically appropriate, customer-friendly, quality health services and 4. Engage MCHD workforce and improve operational functions to meet current and developing population health needs; and supports one of the ten essential public health services, specifically: 8. Assure competent public and personal health care workforce.

 

OTHER AGENCY INVOLVEMENT:

The Office of the County Counsel and the Auditor-Controller have reviewed and approved this Amendment No. 2 as to form and fiscal provisions, respectively. 

 

FINANCING:

The Agreement is funded by Federal Funding Participation (FFP) and Realignment funds.  The funds for FY 2019-20, for this Agreement are included in the Health Department’s Behavioral Health Bureau (HEA012, Unit 8410) FY 2019-20 Adopted Budget.  The funds for this Agreement for FY 2020-21 will be included in the Health Department’s Behavioral Health Bureau (HEA012, Unit 8410) FY 2020-21 Requested Budget.
