a. RECOMMENDATION:
It is recommended that the Board of Supervisors:
a. Approve and authorize the Chief Probation Officer to sign an Agreement with the Community Hospital of the Monterey Peninsula (CHOMP) Tyler Heart Institute to provide ongoing review, compliance assistance, maintenance and oversight services under the Automated External Defibrillator (AED) Program at no cost to the County; and
b. Accept non-standard indemnification provisions as recommended by the Chief Probation Officer.
SUMMARY:
The Probation Department is recommending approval of an Agreement with the Community Hospital of the Monterey Peninsula (CHOMP) Tyler Heart Institute to provide ongoing program review, compliance assistance, and maintenance and oversight services for four (4) Automated External Defibrillators (AED) to be purchased for use in Probation facilities under the AED Program. These services are at no cost to the County.
DISCUSSION:
The Community Hospital of the Monterey Peninsula (CHOMP) Tyler Heart Institute provides a full range of cardiac service, including management of community-based AED programs.
Since 2016, they have provided this valuable service to the County of Monterey for the AEDs located at the Government Center, at Schilling Place, and at the Department of Social Services. The Probation Department is looking to purchase four (4) AEDs that would also be enrolled under the Tyler Health Institute AED Program. There is no annual cost for the maintenance support or enrollment in the program. Services under this Agreement will not commence until authorized by the Board and will be provided on an on-going basis.
Probation is also recommending the approval of the exception to the standard County indemnification terms, which waive any claim against CHOMP, Tyler Institute, and the Via Heart Project arising from the use of the AEDs in Probation’s facilities.
OTHER AGENCY INVOLVEMENT:
County Counsel has reviewed the proposed Agreement and cannot approve non-standard indemnification terms, which waive any claim against CHOMP, Tyler Institute, and the Via Heart Project arising from the use of the AEDs in Probation’s facilities. The Auditor-Controller has reviewed and approved as to fiscal provisions.
FINANCING:
Funding for the purchase of the AEDs is included in Probation’s Budget for FY 20-21. There is no additional cost to the County General Fund associated with this recommendation.
BOARD OF SUPERVISORS STRATEGIC INITIATIVES:
This recommendation supports key objectives of Health and Human Services by providing access to life saving tools to intervene effectively in the case of an emergency.
