RECOMMENDATION:

It is recommended that the Budget Committee support a recommendation to the Board of Supervisors to:

a.  Approve the Memorandum of Understanding by and between the Monterey Regional Waste Management District and the County of Monterey regarding the litter abatement program for an amount not to exceed $25,000, and a period concluding June 30, 2021

b.  Approve the Memorandum of Understanding by and between the Salinas Valley Solid Waste Authority and the County of Monterey regarding the litter abatement program for an amount not to exceed $100,000, and a period concluding June 30, 2021.

c.  Authorize and direct the Auditor-Controller to amend the Fiscal Year 2020-21 Adopted Budget, General Fund, Fund 001, Litter Control Appropriation Unit RMA002, decreasing appropriations and estimated revenue by $75,000. (4/5th vote required)

 

SUMMARY:

Monterey County Resource Management Agency (RMA) operates a Litter Abatement Program (Program), which provides for the collection and disposal of litter, debris, and hazardous materials dumped illegally along County roads and public rights-of-way and on public lands. Annually, the Program removes 150-200 tons of household and industrial materials from County roadways and operates seven (7) days a week.  In March 2020, the Board of Supervisors directed staff to expand its current efforts in areas where illegal dumping is prevalent.

 

RMA and Health Department-Environmental Health Bureau (EHB) are working with the Salinas Valley Solid Waste Authority (SVSWA) and Monterey Regional Waste Management District (MRWMD) to develop a coordinated program where contractors engaged by the County would collect waste and mitigate illegal dumping throughout the county.  SVSWA and MRWMD are committed to promoting sustainable, environmentally sound, cost-effective practices through systems of waste reduction, reuse, recycling, innovative technology, and education.  Both agencies wish to collaborate with the County to increase litter abatement efforts.  The County requested that the two waste districts each allocate $100,000 to enhance the existing litter abatement efforts in Fiscal Year (FY) 2020-21 and began drafting Memorandums of Understanding to record their funding commitment to supplement the County’s Program.  Pending finalization of the MOUs and County issuance of a Request for Proposal (RFP) for contractors to remove illegal dumping, the enhanced litter abatement removal effort is anticipated to begin in Fall 2020.

 

DISCUSSION:

County RMA Litter Abatement Program crews are extended beyond their capacity to remove the current volume of litter dumped along County roads and public rights-of-way and on public lands.  RMA seeks to supplement the removal of illegal dump sites using private contractors.  MOUs have been drafted with SVSWA and MRWMD to support  targeted contractor cleanup of illegal dumping sites before blight can spread.  MRWMD approved funding the Program and the substantive draft MOU (Attachment A) on June 19, 2020.  SVSWA’s budget committee agreed to fund the Program on March 23, 2020, and will sign the draft MOU (Attachment B) on August 20, 2020.

 

RMA’s FY 2020-21 Adopted Budget for Litter Control Appropriation Unit RMA002 included the assumption that SVSWA and MRWMD would collectively provide $200,000 for the Program.  Upon reviewing the proposed FY 2020-21 MOUs, SVSWA agreed to provide the County $100,000 to match up to 50 percent (50%) of the Program’s third-party costs; however, MRWMD advised that it will commit $25,000 only to match up to 50% of these costs due to a change in its financial circumstances related to the COVID-19 outbreak.  Both waste companies agree that extension of the funding and term may be possible after reviewing the results of the FY 2020-21 Program.

 

RMA requests that the Budget Committee authorize and direct the Auditor-Controller to amend the Fiscal Year 2020-21 Adopted Budget, General Fund, Fund 001, Litter Control Appropriation Unit RMA002, decreasing appropriations and estimated revenue by $75,000 to accurately reflect the terms of the MOUs, and actual funding commitments from SVSWA and MRWMD.  The County’s Litter Abatement Program base funding remains constant, including current RMA staffing positions in the Litter Control Budget RMA002.  Abatement within County rights-of-way is performed by RMA-Public Works crews and is eligible for using Road Funds.  Removal of illegal dumping on County (public) lands other than rights-of-way is performed by RMA-Facilities.  The proposed MOUs will enhance the current base program using funding from the two waste districts.

 

OTHER AGENCY INVOLVEMENT:

RMA’s FY 2020-21 Program is a planned cooperative effort among County EHB, MRWMD, SVSWA, and third-party contractors.

 

FINANCING:

The FY 2020-21 Adopted Budget for the Litter Control Appropriation Unit RMA002 assumed that SVSWA & MRWMD would collectively provide $200,000 for the Program.  Under the terms of the proposed MOUs, SVSWA and MRWMD will reimburse the County up to 50 percent (50%), but no more than $100,000 and $25,000, respectively, for third-party labor costs associated with the Program. 

 

Per the MOUs, the County will incur costs and submit invoices to SVSWA and MRWMD for reimbursement.  A temporary impact to cash will result until the reimbursement is received. 

To receive full reimbursement of $125,000, the County Match is $250,000.  This match will be met by utilizing the County’s Litter Abatement Program staff budgeted in the General Fund, Fund 001, Litter Control Appropriation Unit RMA002.  Additionally, RMA’s FY 2020-21 Adopted Budget for the Road Fund, Fund 002, Appropriation Unit RMA012, includes $100,000 for Litter Control as part of the County’s ongoing litter abatement efforts.
