RECOMMENDATION:

It is recommended that the Board of Supervisors:

a.                      Approve Amendment No. 8 to Professional Services Agreement No. A-11432 with Biggs Cardosa Associates, Inc. to continue to provide additional services associated with the completion of the Nacimiento Lake Drive Bridge Replacement Project at San Antonio River, County Bridge No. 449, State Bridge No. 44C-0009, Project No. 2202, Federal Aid Project No. STPLZ-5944 (040), to: update the hourly rates; increase the not to exceed amount by $57,800 for a total amount not to exceed $1,501,880 with no extension to the term from February 9, 2009 to December 31, 2022; and

b.                     Authorize the Contracts/Purchasing Officer or Contracts/Purchasing Supervisor to execute Amendment No. 8 to Professional Services Agreement No. A-11432 and future amendments to the Agreement where the amendments do not significantly alter the scope of work or increase the approved Agreement amount.

 

SUMMARY/DISCUSSION:

The Nacimiento Lake Drive Bridge Replacement Project (Project), County Bridge No. 449 will construct a new bridge on Nacimiento Lake Drive over the San Antonio River.  The existing bridge is one (1) lane and was determined to be seismically deficient and is programmed to be replaced under the State Seismic Retrofit Program. 

 

The County of Monterey, Resource Management Agency (RMA) has identified a need for Biggs Cardosa Associates, Inc. (BCA) to add the re-application of a “Streambed Alteration Agreement” to the California Department of Fish and Wildlife (CDFW), redesign the bridge barrier rail from a Type 80 to a Texas Type C411, and to add two (2) 6” utility conduits to the bridge bay and roadway approaches to the scope of the Professional Services Agreement (PSA) for the Project.

 

The existing CDFW op-law permit expires in October 2020 and cannot be extended.  A new application including new application fee is needed to allow for construction to occur beyond 2020.  The task of obtaining the new CDFW permit is included in Amendment No. 8 to the PSA with BCA.

 

During the fall of 2019, the Federal Highway Administration (FHWA) and the California Department of Transportation (Caltrans) required all bridges using federal funds to use a bridge barrier rail that was crash tested and “Manual for Assessing Safety Hardware” (MASH) approved.  To meet this requirement, a revision of the Caltrans Type 80 bridge barrier rails that were specified in the plans need to be redesigned to Texas Type C411 bridge barrier rails for compliance.  The Texas Type C411 bridge barrier rail has been crash tested and MASH approved where the Caltrans Type 80 bridge barrier rail has not.  Both the Caltrans Type 80 bridge barrier rail (which was used for the Highway 68 bridge over the Salinas River) and the Texas Type C411 bridge barrier rail have a see-through appearance as required in the Environmental Impact Report (EIR).  This change in bridge barrier rail design is also included in Amendment No. 8 to the PSA.

 

The existing PG&E overhead electrical line interfered with the construction of the new bridge and the County is required to have the line relocated for the Project to be constructed without interference.  PG&E had prior rights to their overhead electrical line and the County is under agreement to compensate them for the required relocation using federal utility relocation funds for the Project.  In discussion with PG&E they indicated that two (2) additional poles would be required for the permanent overhead electrical line relocation design that was originally provided by PG&E for the Project.  The redesign was required by a reduced maximum spacing of power poles for overhead electrical lines that has recently been adopted by PG&E.  In the discussion with PG&E about the redesign, it was decided to place underground conduits into the bridge approach roadway and bridge bays using utility conduits. This change in bridge design for the utility conduits is also included in Amendment No. 8 to the PSA.

 

Amendment No. 8 will allow BCA to address the changes to the design of the Plans, Specifications and Estimate (PS&E) required for compliance which were not anticipated or included in the original PSA or its subsequent amendments.  With the approval of Amendment No. 8, BCA would be authorized to update the PS&E with recent design and permitting requirements.  Completion of the PS&E and associated bid documents will allow for advertisement for a construction contract and solicitation of bids for construction of the Project this fall.  Construction of the Project is scheduled to begin in the fall or winter of 2020.

 

Approval of the proposed Amendment No. 8 will allow BCA to continue to provide services associated with the compliance needs as described above for completion of the Project.  Amendment No. 8 will allow an update to the hourly rates; and increase the not to exceed amount of $1,444,080 by $57,800 for a total amount not to exceed $1,501,880 with no extension to the term from February 9, 2009 to December 31, 2022. 

 

Attachment A provides a summary of the PSA to date and Attachment B provides a summary of the PSA current annual expenditures and balance.

 

 

OTHER AGENCY INVOLVEMENT:

The Office of the County Counsel and the Auditor-Controller’s Office have reviewed and approved Amendment No. 8 as to form, and fiscal provisions, respectively.

 

FINANCING:

The total estimated cost of the Project, including design engineering, environmental, right-of-way, utilities and construction is $10,572,237.  Expenditures incurred for this PSA from Fiscal Year (FY) 2008-09 through FY 2019-2020 total $1,180,097.  With the approval of Amendment No. 8, funds in the amount of $57,800 will allow BCA to obtain a CDFW permit, change the bridge barrier rail to a Texas Type C411 barrier rail, and incorporate utility conduits into the bridge and bridge approaches for the Project.

 

The County has secured FHWA funding for the identified Project as outlined in Attachment L, Project Budget.  Federal funds for Construction authorization in the amount of $7,020,000 were provided by FHWA through Caltrans on February 5, 2020. 

 

The Project is largely funded (88.53%) by FHWA Highway Bridge Program (HBP) funds in the amount of $8,326,325, and State Seismic funds (11.47%) in the amount of $949,774.  The remaining $1,412,597 will be funded through Local funds such as Measure X and the Road Fund.  There are sufficient appropriations adopted in the FY 2020-21 Road Fund 002, Appropriations Unit RMA 012 Budget to finance Amendment No. 8.

 

BOARD OF SUPERVISORS STRATEGIC INITIATIVES:

The Project will replace the existing seismically deficient one (1) lane bridge with a new two (2) lane bridge that meets current Caltrans design standards.  Also, as part of the proposed Project, the bridge approaches will be reconstructed and thereby improve the pavement condition of this section of Nacimiento Lake Drive.  The recommended action complies with the Board of Supervisors’ Strategic Initiatives for Infrastructure and Public Safety.
