Approve Utility Agreement No. 2202.1- Amendment No.1 between the County of Monterey and Pacific Gas and Electric (PG&E) to delete the prior utility relocation plans and incorporate the updated utility relocation plans provided by PG&E and to reduce the estimated cost of relocation from $125,600 to $93,900 for the relocation of electric distribution lines and poles as part of the Nacimiento Lake Drive Bridge Replacement Project; and

b. Authorize the Director of Community Services Department or Successor to execute the Utility Agreement No. 2202.1- Amendment No. 1 with PG&E.

RECOMMENDATION:

It is recommended that the Board of Supervisors:

a.                     Approve “Utility Agreement No. 2202.1- Amendment No.1” between the County of Monterey and Pacific Gas and Electric (PG&E) to delete the prior utility relocation plans and incorporate the updated utility relocation plans provided by PG&E and to reduce the estimated cost of relocation from $125,600 to $93,900 for the relocation of electric distribution lines and poles as part of the Nacimiento Lake Drive Bridge Replacement Project; and

b.      Authorize the Director of Community Services Department or Successor to execute the Utility Agreement No. 2202.1- Amendment No. 1 with PG&E.

 

SUMMARY:

Monterey County Resource Management Agency (RMA), successor Department Community Services Department, representing the County of Monterey entered into Utility Agreement No. 2202.1 between the County of Monterey and Pacific Gas and Electric (PG&E) for the relocation of electric distribution lines and poles as a part of the Nacimiento Lake Drive Bridge Replacement Project.  PG&E has instituted new requirements that have reduced the allowed spacing between PG&E poles supporting overhead lines.  The required reduction in PG&E pole spacing required the redesign of proposed relocation plans for the initial Phase I relocation prior to construction and final Phase II relocation after construction.  PG&E also reduced the estimated cost of the relocation from $125,600 to $93,900.  “Utility Agreement No. 2202.1- Amendment No. 1” between the County of Monterey and PG&E will replace the original utility relocation plans with the revised Phase I and Phase II electrical facility relocation plans.  Amendment No. 1 will also reduce the original contract estimated cost of $125,600 to $93,900 to reflect the reduction in the estimated cost provided by PG&E.

 

DISCUSSION:

Nacimiento Lake Drive Bridge is an existing one-lane bridge located southwest of the community of Bradley and east of Lake San Antonio, in southern Monterey County.  This bridge was determined to be seismically deficient.  Staff has programmed replacing the existing bridge with a new two-lane bridge under the State Seismic Retrofit Program.  As part of the proposed project, the bridge approaches will be reconstructed; thereby improving the pavement condition of this section of Nacimiento Lake Drive.

 

The Community Services Department has completed the design and right-of-way engineering for the project.  The Monterey County Board of Supervisors adopted the plans and Special Provisions and Authorized the Resource Management Agency Director to advertise the “Notice to Bidders”.  The apparent low bidder is Papich Construction, Inc., and construction contract for the Project is scheduled to be considered by the Board of Supervisors for awarded on December 8, 2020.

 

The PG&E pole relocations for Phase I need to be complete prior to the beginning of construction.  PG&E cannot begin the relocation of the overhead electrical distribution lines and poles until “Utility Agreement No. 2202.1 - Amendment No. 1” is approved by the Board of Supervisors and fully executed.

 

OTHER AGENCY INVOLVEMENT:

The Office of the County Counsel-Risk Manager, and Auditor-Controller’s Office have reviewed and approved the “Utility Agreement No. 2202.1- Amendment No. 1” as to form, fiscal provisions, and legality.

 

FINANCING:

Caltrans has authorized $125,000 of federal HBP funds to reimburse PG&E for the electrical distribution lines and poles.  These funds will be utilized by Monterey County to reimburse PG&E after the relocations are complete and PG&E has invoiced Monterey County.

 

The total estimated project cost, including engineering design, environmental documentation and permitting, right-of-way, utility relocation, and construction is $10,860,353.  The project is largely funded by the Federal Highway Administration’s (FHWA) Highway Bridge Program (HBP) in the amount of $8,478,294.  The project is also funded by State Seismic Funds, Measure X, and the Road Fund.  There are sufficient appropriations adopted in the FY2020-21 Road Fund 002, Appropriation Unit RMA 012 Budget to finance the construction phase of the project.

 

BOARD OF SUPERVISORS STRATEGIC INITIATIVES:

The project will replace the existing seismically deficient Nacimiento Lake Drive Bridge with a new two (2) lane bridge that meets Caltrans Design Standards.  Also, as part of the proposed project the bridge approaches will be reconstructed and thereby improving the pavement condition of this section of Nacimiento Lake Drive.  The recommended action supports the following Board of Supervisors’ Strategic Initiative:
