Title: a. Approve and authorize the Director of the Department of Social Services to sign a zero dollar Agreement with Cake4Kids to provide free birthday and special occasion cakes to foster children and youth in care effective February 1, 2021 through January 31, 2022 with nonstandard liability and indemnification provisions; and b. RECOMMENDATION:
It is recommended that the Board of Supervisors:
a. Approve and authorize the Director of the Department of Social Services to sign a zero dollar Agreement with Cake4Kids to provide free birthday and special occasion cakes to foster children and youth in care effective February 1, 2021 through January 31, 2022 with nonstandard liability and indemnification provisions; and
b. Authorize the Director of Social Services to sign up to three (3) amendments to this Agreement as long as they do not encompass payment or significantly change the scope of services.

SUMMARY/DISCUSSION:
Cake4Kids' mission is to help foster and at risk children and youth feel special at least one day a year, to raise their self-esteem, and to increase their chance of success in life knowing that people care for them. The primary method of mission delivery is by providing free.cakes or other baked goods for birthdays and other special occasions to foster care and at-risk children and youth who wouldn't otherwise have a treat to celebrate the occasion.

Due to the unique nature of the service and the low risk to the County, the Department recommends the Board approve this Agreement with nonstandard liability and indemnification provisions.

OTHER AGENCY INVOLVEMENT:
The Auditor Controller has reviewed and approved the agreement. County Counsel has approved the agreement as to form.
