a. Declare 1996 John Deere Backhoe Loader Model 710d, vehicle identification number 96N742, as surplus property and relinquish all County ownership rights applicable to the backhoe loader; and
b. Approve and authorize the Contracts/Purchasing Officer or designee to release 1996 John Deere Backhoe Loader Model 710d, vehicle identification number 96N742, to Monterey County Regional Fire District in furtherance of its ongoing programs, pursuant to the County’s standard vehicle release procedure.

RECOMMENDATION:
a. Declare 1996 John Deere Backhoe Loader Model 710d, vehicle identification number 96N742, as surplus property and County relinquish all ownership rights applicable to the backhoe loader; and
b. Approve and authorize the Contracts/Purchasing Officer or designee to release 1996 John Deere Backhoe Loader Model 710d, vehicle identification number 96N742, to Monterey County Regional Fire District in furtherance of its ongoing programs, pursuant to the County’s standard vehicle release procedure.
SUMMARY/DISCUSSION:
Government Code 25372 expressly authorizes donation of surplus property of a county to a tax-exempt organization, and Monterey County Regional Fire District has shown interest in this surplus material, as shown in exhibit A. This piece of equipment will help further their mission in providing services to the County of Monterey during emergencies and will specifically help with flooding and mudslides from the recent fires. Monterey County Regional Fire District will accept all transfer rights, including but not limited to, accepting the equipment as-is; accepting all responsibilities for further maintenance and repair; accepting all liability (through the County’s standard release); and providing insurance for the equipment.

OTHER AGENCY INVOLVEMENT:
The County of Monterey Fleet Management, which granted the funds used for the original purchase of the backhoe loader, concurs with the recommended actions. In addition, the County Counsel, Contracts/Purchasing, and the County Administrative Office have reviewed and approved this Board Report.
FINANCING:
There is no impact to the County General Fund.
