RECOMMENDATION:

It is recommended that the Board of Supervisors:

a. Approve and authorize the Director of Health or Assistant Director of Health to execute a one-year Mental Health Services Agreement with Crestwood Behavioral Health, Inc. for the provision of mental health services for adults with severe psychiatric disabilities, for a maximum County obligation of $954,840 for the term of July 1, 2021 through June 30, 2022; and

b. Approve the Director of Health’s recommendation to accept non-standard indemnification, where vendor assumes liability in the event of sole or willful negligence only, and

approve non-standard insurance provisions in Agreement; and

c. Approve and authorize the Director of Health or Assistant Director of Health to approve up to three (3) future amendments that do not exceed ten percent (10%) ($95,484) of the original Agreement amount and do not significantly alter the scope of services.

 

SUMMARY/DISCUSSION:

Crestwood Behavioral Health, Inc. has provided mental health services for approximately 17 years, and for 30 years prior under the previous corporate umbrella of Crestwood Hospitals.  Crestwood has 18 California facilities ranging in size from 12 to nearly 200 beds, four of which are covered under the terms of this Contract.  Crestwood's programs provide recovery oriented psychiatric services to adults, older adults, and transition-aged youth with severe and persistent mental health illnesses. Crestwood provides intensive treatment programs with a high level of security and education to assist clients to live independently.  Crestwood treatment services include an individualized program to meet the specific needs of each client, and a structured regimen with services to assist clients in their development of new skills.

 

The County currently maintains Agreement A-14794 with Crestwood Behavioral Health, Inc. which will expire on June 30, 2021.  This new Agreement continues the past relationship with Crestwood Behavioral Health, Inc. into the next fiscal year, with a 3.7% cost of living increase under new Crestwood corporate published rates.  The Agreement includes and extends the expiring FY 2020-21 contract provisions with two Crestwood Mental Health Rehabilitation Centers and two Skilled Nursing Facilities, helping to maintain County treatment options for older adults.

 

The approval of this Agreement will provide the necessary resources and increase the options for clients to be placed in a facility that best suits their needs and to live in the least restrictive community setting as possible.  This Agreement meets the requirements of the State Welfare and Institutions Code 5600 (Bronzan-McCorquodale Act), the California Code of Regulations Titles 9 and 22, and sustains the continuity of care services to seriously mentally ill clients of Monterey County.

 

This Agreement contains a modified risk provision that states that the vendor will be indemnified for any and all claims, unless the vendor is solely or willfully negligent. This agreement also contains non-standard auto insurance provision that covers the County of Monterey as an additional insured, only for sole negligent acts. This Agreement contains the County’s standard 30-day “no cause” provision (Section IV, B) and an additional defunding provision (Section IV, D), which provides the County the ability to amend or terminate the Agreement in the event of a reduction and/or termination of funding.

 

This work supports the following Monterey County Health Department 2018-2022 Strategic Plan Initiative: 3. Ensure access to culturally and linguistically appropriate, customer-friendly, quality health services.  It also supports one of the ten essential public health services, specifically: 7. Link people to needed personal health services and assure the provisions of health care when otherwise unavailable.

 

OTHER AGENCY INVOLVEMENT:

The Office of County Counsel and Auditor-Controller have reviewed and approved this Agreement as to form and fiscal provisions, respectively.

 

FINANCING:

This Agreement is 100% funded by 1991 Mental Health Realignment revenues.  The funds for this Agreement ($954,840) are included in the Health Department’s Behavioral Health (HEA012, Unit 8410) Fiscal Year 2021-22 Requested Budget.
