RECOMMENDATION:

It is recommended that the Board of Supervisors:

a. Approve Amendment No. 1 to the Memorandum of Understanding by and between the Salinas Valley Solid Waste Authority and the County of Monterey regarding the Litter Abatement Program to extend the term for two (2) additional years through June 30, 2023, for an amount not to exceed $100,000 per fiscal year; and

b. Approve Amendment No. 1 to the Memorandum of Understanding by and between the Monterey Regional Waste Management District and the County of Monterey regarding the Litter Abatement Program to extend the term for two (2) additional years through June 30, 2023, for an amount not to exceed $25,000 per fiscal year.

 

SUMMARY/DISCUSSION:

Monterey County Public Works, Facilities and Parks (PWFP) operates a Litter Abatement Program (Program), which provides for the collection and disposal of litter, debris, and hazardous materials dumped illegally along County roads and public rights-of-way and on public lands.  The Program removes 150-200 tons of household and industrial materials from County roadways annually.

 

Salinas Valley Solid Waste Authority (SVSWA) and Monterey Regional Waste Management District (MRWMD) provide funds under established Memorandums of Understanding (MOUs) for supplemental collection and mitigation efforts by the County using contracted services.  The MOUs established in Fiscal Year (FY) 2020/21 provide $100,000 from SVSWA and $25,000 from MRWMD to support these litter abatement efforts.

 

SVSWA and MRWMD are committed to promoting sustainable, environmentally sound, cost-effective practices through systems of waste reduction, reuse, recycling, innovative technology, and education.  PWFP, SVSWA and MRWMD have agreed to extend their respective MOUs for an additional two (2) years at the existing annual funding rate per fiscal year to minimize the administrative burden associated with preparing annual MOUs, and to continue litter abatement programs in the County.

 

OTHER AGENCY INVOLVEMENT:

The Office of the County Counsel has reviewed and approved Amendment No. 1 to each MOU as to form.  PWFP’s FY 2021-22 Litter Abatement Program is a planned cooperative effort among the MRWMD, the SVSWA, the Monterey County Health Department Environmental Health Bureau (EHB), and third-party contractors.

 

FINANCING:

The FY 2021-22 Recommended Budget for the Litter Control Appropriation Unit PFP002 includes the assumption that SVSWA and MRWMD would collectively provide $125,000 for the Litter Abatement Program.  Under the terms of the proposed Amendments to the MOUs, SVSWA and MRWMD will reimburse the County up to Fifty Percent (50%), but no more than $100,00 and $25,000 per fiscal year, respectively, for third-party labor costs associated with the Program.  The County will incur costs and submit invoices to SVSWA and MRWMD for reimbursement per the terms of the respective MOUs.  A temporary impact will result to the Road Fund, Fund 002 until reimbursements are received from the SVSWA and MRWMD.

 

PWFP has also budgeted $100,000 in the FY 2021-22 Recommended Budget for the Road Fund, Fund 002, Appropriation Unit PFP004, for Litter Control as part of the County’s ongoing litter abatement efforts.

The recommendation complies with the Board of Supervisors’ Administration Strategic Initiative by ensuring accurate, timely, and transparent fiscal accounting and effective resource management which enables the PWFP to complete essential public services.
