Title: a. RECOMMENDATION:

It is recommended that the Board of Supervisors:

a. Approve and authorize the Director of Health or Assistant Director of Health to execute a three-year Mental Health Services Agreement with Oaklandidence Opco, LLC DBA Medical Hill Healthcare Center in Oakland, California for the provision of skilled nursing services for organic brain syndrome, traumatic brain injured, and medically debilitated patients, in the amount of $1,050,420 for Fiscal Year (FY) 2021-22, $1,085,358 for FY 2022-23, and $1,121,521 for FY 2023-24, for a maximum County obligation of $3,257,300 for the retroactive term of July 1, 2021 through June 30, 2024; and

SUMMARY/DISCUSSION:

Oaklandidence Opco, LLC (formerly Medical Hill Rehabilitation Center, LLC) is a Medi-Cal Freestanding Skilled Nursing Facility Level-B (FS/NF-B) designated as an Institution for Mental Disease (IMD).

 

Located in Oakland, California, Oaklandidence Opco, LLC DBA Medical Hill Healthcare Center is a mental health rehabilitation center for adults with psychiatric impairments and disabilities that require a locked skilled nursing level of care.  The services of Medical Hill Healthcare Center are necessary to maintain medical continuity of critical mental health care services provided to County of Monterey adult patients with severe mental illness.  The Medical Hill program is a specialized care program that provides skilled nursing services to organic brain syndrome, traumatic brain injured, and medically debilitated patients. 

 

This Agreement with Oaklandidence Opco, LLC is for a three (3) fiscal year term from July 1, 2021 to June 30, 2024, which renews and updates Agreement A-14002 which expired on June 30, 2021.  This new Agreement maintains the same contract provisions as the FY 2018-21 Agreement, however, gives an overall 12% decrease in annual total County obligation.  This decrease is also realized by readjusting previous automatic increases given by the County in compliance with AB 1054 legislation, which increases were frozen by the State seven months after the previous agreement was fully executed. This reallocation and reduction allow critically needed funds to be distributed to other programs in the Adult System of Care. 

 

This Agreement is late in being presented to your board due to a five-week delay from the vendor and their Insurance broker in supplying Insurance listing the County as Additional Insureds under the policy, as required by County Contracts & Purchasing and Risk Management.

 

This Agreement contains the County’s standard 30-day “no cause” provision (Section IV, B) and an additional defunding provision (Section IV, D), which provides the County the ability to amend or terminate the Agreement in the event of a reduction and/or termination of funding.  This Agreement also contains a Commercial General Liability insurance provision of claims-based coverage.

 

This work supports the following Monterey County Health Department 2018-2022 Strategic Plan Initiative: 3. Ensure access to culturally and linguistically appropriate, customer-friendly, quality health services.  It also supports one of the ten essential public health services, specifically: 7. Link people to needed personal health services and assure the provisions of health care when otherwise unavailable.

 

OTHER AGENCY INVOLVEMENT:

The office of the County Counsel-Risk Management and Auditor-Controller have reviewed and approved this Agreement as to legal form and fiscal provisions, respectively.

 

FINANCING:

This Agreement is funded by Realignment revenues.  The funds for this Agreement ($1,050,420) are included in the Health Department’s Behavioral Health (HEA012, Unit 8410) Fiscal Year 2021-22 Adopted Budget.  The funds for this Agreement for FY 2022-23 ($1,085,358) and FY 2023-24 ($1,121,521) will be included in the Health Department’s Behavioral Health (HEA012, Unit 8410) Fiscal Year 2022-23 and Fiscal Year 2023-24 Requested Budgets.
