RECOMMENDATION:

It is recommended that the Board of Supervisors adopt a Resolution to certify the adoption of Caltrans Local Assistance Procedures Manual Chapter 10.

 

SUMMARY/DISCUSSION:

The State of California Department of Transportation (Caltrans) has developed the

Local Assistance Procedures Manual (LAPM), Chapter 10, Consultant Selection, which sets forth policies and procedures for procurement and management of contracts for engineering and design related consultant services contracts on federal and state funded transportation projects. The purpose of the manual is to ensure compliance with applicable Federal and State laws and regulations.  The recommended action will formalize the County’s adoption of Caltrans LAPM Chapter 10, which will ensure full compliance with LAPM Chapter 10.

 

The LAPM Chapter 10, Consultant Selection, describes the consultant selection and

procurement process local agencies must follow to maintain eligibility for Federal and State

reimbursement.  The Code of Federal Regulation §23 CFR 172.5(b)(1) requires subrecipients to adopt written policies and procedures prescribed by the awarding state transportation agency for the procurement, management, and administration of engineering and design related consultant services in accordance with applicable Federal and State laws and regulations. For California, that state transportation agency is Caltrans. In addition, the provisions of §23 CFR 172.5(b) state that subrecipients shall develop and sustain organizational capacity and provide the resources necessary for the procurement, management, and administration of engineering and design related consultant services, reimbursed in whole or in part with Federal-Aid Highway Program funding as specified in United State Code §23 U.S.C. 106(g)(4)(A).

 

OTHER AGENCY INVOLVEMENT:

Pursuant to §23 CFR 172.5(b)(1), in its capacity as the awarding state transportation agency, Caltrans requires that subrecipients adopt written policies and procedures for the procurement, management, and administration of engineering and design related consultant services in accordance with applicable Federal and State laws and regulations.  Adoption of the LAPM Chapter 10, Consultant Selection, complies with §23 CFR 172.5(b)(1). 

 

FINANCING:

There is no direct financial impact to the County to adopt Caltrans LAPM Chapter 10. However, not adopting the LAPM Chapter 10 could put the County at risk of losing millions of dollars of State and Federal funding.

 

BOARD OF SUPERVISORS STRATEGIC INITIATIVES:

The adoption of Caltrans LAPM Chapter 10 will ensure compliance when the County procures consultant services for federally funded infrastructure project. The recommended action supports the following Board of Supervisors’ Strategic Initiatives:
