RECOMMENDATION:

It is recommended that the Board of Supervisors:

a.                     Support amending the Office of Public Defender Fiscal Year 2021-22 Adopted Budget

(001-2270-PUB001-8169) to reallocate one (1) Deputy Public Defender IV (39P31) to one (1) Assistant Public Defender (12C11) as indicated in Attachment A.

b.                     Support authorizing the Auditor-Controller and County Administrative Office to incorporate the position change in the FY 2021-22 Adopted Budget; and

c.                     Support directing the Human Resources Department to implement the changes in the Advantage HRM system.

 

 

SUMMARY/DISCUSSION:

 

The Public Defender’s Office requests the reallocation of Deputy Public Defender IV (DPD IV) to an Assistant Public Defender (APD). The change in structure is critical to effectively supervise and manage the duties and responsibilities of the Department. Supervisory responsibilities and duties have increased for both the civil and criminal divisions of the department. New legislative mandates have expanded the role of Office of Public Defender. Supervision and management of grant funding received by the department has grown dramatically requiring additional hours to apply for, manage, and report distribution of said funding in compliance with State and County guidelines. This reallocated position will allow the department to modify its organizational structure in the criminal and civil divisions to respond to these changes and allow the Department to function at its highest level in accordance with its Constitutional, State and Federal requirements.

 

OTHER AGENCY INVOLVEMENT:

The Human Resources Department reviewed and approved the Request to Classify and concurs with the recommendation.

 

FINANCING:

The increased cost of salary and benefits is estimated $43,848 annually and will be absorbed within the FY 2021-22 Office of the Public Defender Unit: 2270-8169-Fund 001- Appropriation Unit-PUB001.There will be no additional impact to the General Fund Contribution.
