RECOMMENDATION:

It is recommended that the Board of Supervisors:

Receive the notice of adjustment of the annual salary of the members of the Board of Supervisors, in accordance with Section 2.04.370C of the County of Monterey Code consistent with the superior court judge salary adjustments of 0.5562% retroactive to July 1, 2021. The salary adjustments will be implemented January 29, 2022 retroactive to July 1, 2021.

 

SUMMARY/DISCUSSION:

Section 2.04.370C of the County of Monterey Code mandates that salary of the members of the Board of Supervisors be adjusted by the same percentage rate applicable to the office of superior court judge. On November 16, 2021, the Human Resources Department brought forward a Notice of Adjustment of the Annual Salary of the Members of the Board of Supervisors for FY 2021-22 which outlined salary increases that were calculated at that time consistent with the superior court judge salary adjustments of 4.3% retroactive to July 1, 2021.  The Human Resources Department has subsequently received the attached December 6, 2021 memorandum from the Judicial Council of California and Exempt Pay Letter from the California Department of Human Resources (CALHR), detailing additional salary increases provided to superior court judges for FY 2021-22 due difference between the previously provided 4.30% and the newly calculated 4.8562%, which is an adjustment of 0.5562%.

 

Under Section 2.04.370C, a notice of any adjustment in compensation paid to members of the Board of Supervisors shall appear on the agenda of a regular meeting of the Board of Supervisors at least ten (10) days prior to the date such adjustment is implemented; however, the effective date of such adjustment shall be the date any adjustment is effective for superior court judge. As such, this salary adjustment pursuant to the Code will be implemented January 29, 2022 retroactively to July 1, 2021.

 

Please note that the adjustments provided in Section 2.04.0370C are automatic; action by the Board of Supervisors is not required or necessary for the adjustments to go into effect.

 

OTHER AGENCY INVOLVEMENT:

The County Administrative Office and Office of the County Counsel has reviewed and concurs with this report.

 

FINANCING:

The salary adjustments will result in retroactive costs of approximately $3,015 from July 2021 to January 2022 and $2,154 from February 2022 to June 2022; for a total cost of approximately $5,169 for FY 2021-22. These salary adjustments were not included in the recently adopted budget for FY 2021-22. To the extent these salary increases cannot be absorbed within existing budget, staff will, as necessary, propose a recommended budget modification. The increased future year costs will be included in the department’s requested budget.

 

BOARD OF SUPERVISORS STRATEGIC INITIATIVES:

The notice of adjustment of the annual salary of the members of the Board of Supervisors is mandated by County Code and is not a part of the Board of Supervisors Strategic Initiatives.
