Title

a. Report

RECOMMENDATION:

It is recommended that the Board of Supervisors:

a.                     Approve and authorize the Contracts/Purchasing Officer or Contracts Purchasing Supervisor to sign Amendment No. 2 to the Agreement between the California Department of Corrections and Rehabilitation and the County of Monterey Probation Department to increase the allocation of  State funding to the County in the amount of $80,000 for a total amount of $1,013,450, for the term September 1, 2020 to June 30, 2023 to continue to provide services to adult parolees participating in the Day Reporting Center operated by GEO Reentry Services, LLC; and

b.                     Approve and authorize the Contracts/Purchasing Officer or Contracts Purchasing Supervisor to execute Amendment No. 2 to the Agreement with the State, and any related documents or amendments.

 

SUMMARY:

The Probation Department is recommending approval of Amendment No. 2 to the Agreement with CDCR for participation of additional parolees to services provided by the DRC in FY2020-21. The DRC provides access to rehabilitative services for both adult offenders under Probation supervision and parolees under State supervision residing in Monterey County.

 

DISCUSSION:

The DRC was implemented in 2009, under a federal grant; Probation is currently utilizing funding from Public Safety Realignment Act funds to continue services to eligible adult offenders under its supervision. The Day Reporting Center offers an evidence-based model with a variety of programs, including counseling, treatment, life skill classes, and employment services to eligible participants. The center is open seven days a week and has an expanded capacity of up to 100 clients per day.

 

Probation has collaborated with GEO Reentry Services, LLC since 2009 in the operation of the Day Reporting Center, which provides treatment and supervision services for adult offenders in a one-stop setting. GEO Reentry Services, LLC was awarded the contract for the DRC following County competitive process under RFP 10760.

 

CDCR has been partnering with the County to provide these services to parolees who are residing in Monterey County after their State incarceration. These services fill a critical gap in the post-custody transition of adult offenders and provide needed rehabilitative services. 

The increase in allocation to this collaboration will allow for the County to continue to optimize the DRC service capacity and extend rehabilitative services to resident parolees in Monterey County, who, with the implementation of Public Safety Realignment, now serve a sentence for technical violation in County Jail instead of State prison.

 

Due to changes in the Automated Reentry Management System (ARMS), the CDCR reporting software that tracks attendance of parolees, the contracted 30 seats for CDCR were exceeded during the months of January - May of 2021. Although the County has been reimbursed for the seats, the CDCR contract now requires amendment to correct the agreement budget and increase the aggregate total amount of reimbursement to the County.  A copy of Amendment No. 2 is on file with the Clerk to the Board.

 

OTHER AGENCY INVOLVEMENT:

The Office of the County Counsel-Risk Management and the Auditor-Controller have reviewed and approved this Amendment to the Agreement as to legal form, risk provisions and fiscal terms. 

 

FINANCING:

The State will allocate an additional $80,000 for the period September 1, 2020 to June 30, 2021, for an aggregate total of $1,013,450 in funding as a reimbursement to Probation for services provided to additional parolees through a subcontract with GEO Reentry Services, LLC, for the term September 1, 2020 - August 31, 2023.

 

These amounts are calculated on the basis of 30 parolee clients, at a daily reimbursement of $35 per client, for an estimated 360 days per fiscal year; reimbursement is provided on actual attendance, not to exceed the contract allocated amount. 

 

There is no anticipated increase in County General Fund Contribution with the current recommended action.

 

BOARD OF SUPERVISORS STRATEGIC INITIATIVES:

This recommendation supports the Board of Supervisor Strategic Initiatives of a) Economic Development by providing employment opportunities and helping to reduce poverty in the adult offender population; and b) Public Safety by encouraging self-sustainability to aid in crime prevention and successful reintegration into the community.
