Adopt a resolution:
a. proclaiming a Local Emergency, consistent with the Proclamation of Local Emergency issued by the County Administrative Officer dated December 26, 2021, in accordance with California Government Code section 8630 et seq., due to heavy flows into the Salinas River lagoon causing conditions that could lead to possible loss of life and property in areas near and adjacent the lagoon; and,
b. ratifying a Proclamation of Local Emergency issued by the County Administrative Officer dated January 4, 2022, in accordance with California Government Code section 8630 et seq., due to heavy rain and wind events causing damage to public infrastructure and private property within Monterey County including localized flooding, roadway slope erosion and embankment slip-outs, debris flows, landslides, and culvert failure affecting the safety of said roadways; obstruction of public roadways from storm water, storm debris and roadway failure; damage to storm drain infrastructure; and damage to public and private utilities and damage to public facilities and parks; such damages resulting in road closures, areas of isolation, loss of power and other critical infrastructure affecting the public’s safety.

RECOMMENDATION:
It is recommended that the Board of Supervisors adopt a resolution:
a) proclaiming a Local Emergency, consistent with the Proclamation of Local Emergency issued by the County Administrative Officer dated December 26, 2021, in accordance with California Government Code section 8630 et seq., due to heavy flows into the Salinas River lagoon causing conditions that could lead to possible loss of life and property in areas near and adjacent the lagoon; and
b) ratifying a Proclamation of Local Emergency issued by the County Administrative Officer dated January 4, 2022, in accordance with California Government Code section 8630 et seq., due to heavy rain and wind events causing damage to public infrastructure and private property within Monterey County including localized flooding, roadway slope erosion and embankment slip-outs, debris flows, landslides, and culvert failure affecting the safety of said roadways; obstruction of public roadways from storm water, storm debris and roadway failure; damage to storm drain infrastructure; and damage to public and private utilities and damage to public facilities and parks; such damages resulting in road closures, areas of isolation, loss of power and other critical infrastructure affecting the public’s safety.
SUMMARY:DISCUSSION:
Due to heavy flows into the Salinas River Lagoon prior to December 26, 2021, potential flooding conditions existed that could have led to the loss of life and property in areas adjacent to the lagoon. In order to allow for lagoon management activities, the County Administrative Officer proclaimed a local state of emergency on December 26, 2021. A copy of the proclamation is enclosed as Attachment A.
In addition, due to heavy rain and wind events occurring between December 20 and 29, 2021, conditions existed in various parts of the unincorporated area that caused damage to public infrastructure and private property, including localized flooding, roadway slope erosion and embankment slip-outs, debris flows, landslides, and culvert failure affecting the safety of said roadways; obstruction of public roadways from storm water, storm debris and roadway failure; damage to storm drain infrastructure; and damage to public and private utilities, public facilities, and parks; such damages resulting in road closures, areas of isolation, loss of power and other critical infrastructure affecting the public’s safety. In order to allow for emergency repairs under these circumstances, the County Administrative Officer proclaimed a local state of emergency on January 4, 2022. A copy of the proclamation is enclosed as Attachment B.
Pursuant to Government Code section 8630, it is necessary for the Board of Supervisors to adopt a resolution ratifying any emergency proclamations issued by the CAO within seven days of issuance. It is too late to ratify the December 26, 2021, proclamation, therefore it is necessary for the Board to proclaim anew that local emergency; the January 4, 2022, can be timely ratified.
OTHER AGENCY INVOLVEMENT:
The Office of Emergency Services and the Public Works, Facilities and Parks Department approve the recommendation.
FINANCING:
There is no impact to the County General Fund with the adoption of this resolution.
BOARD OF SUPERVISORS STRATEGIC INITIATIVES:
This proposed program correlates to the Health & Human Services Strategic Initiatives adopted by the Board of Supervisors by working towards the goals of improving health and quality of life outcomes to individuals and families to address the immediate threat to the public peace, health and safety and prevent displacement of tenants resulting from no-fault evictions and preventing an increase in the homeless population in Monterey County.
